Lawsuits, Threats of violence and 84 years of family history comes to a close

So really really (really) long story short my mom finished signing the final sale documents on the lake cottage that has been in our family for 84 years. My mom and dad had planned to retire there and build a new house but issues with building variances (they got restrictive enough that you couldn't build the same sized cottage that had been there for decades anymore), my father passing away from cancer, distance from children and an asshole neighbor resulted in a change of plans.

Back to the asshole neighbor. To get around the 'Percent of property covered' ordinance my dad bought some land from a neighbor and family friend who had a double lot. The lady behind the lot had wanted a small strip of land leading out to the lake in order to get access to the private lake but had almost no money. Being another family friend my father had a verbal agreement to give her a small strip of land for free so she could put in a pier.

Sadly she unexpectedly passed away during the land transfer process. Her son finds out about the process and loses his shit. Never talked to my dad to find out what was going on - just immediately files suit to stop the transfer of land.

When that failed he came down to talk to my father. While free was off the table my father offered to sell him the strip of land at the same $/ft he paid for everything + lawyers fees from the lawsuit. The neighbor lost his shit again, demanded the land for free and, knowing my father has cancer, threatened to beat my father up and put him back in the hospital. He also mentioned he had enough money to tie up their housing projects until my father dies so he will never see his retirement house built (But not enough money to buy his mother a strip of land to the lake I guess).

He also filed suit again. In the legal back and forth my father again offered to sell the land for the same $/ft plus the ever growing legal fee cost. The suit was again dismissed and the offer turned down.

When fuckhead found out the cottage was being sold after my father passed away the harassment stopped. I am guessing he thought he could offer to buy a small strip of land from the new owners. His wife even came down to ask if they could have the land from us before the sale was finalized. Ha! Fat fucking chance.

Yeah - karma is a bitch fuckhead. Took a little bit of work but we didn't sell all the land. I now own a small L-shaped strip of property.

Good luck getting lake access now. I'll gladly pay property taxes year after year to continue to fuck him over. Maybe I'll put in a pier or something and come out and sit on my land in my folding lawnchair and waive at him. Well he did say he had money. Maybe I'll sell it to him anyway....for an astronomical markup.

The asshole guy stopped the land transfer process on land he actually wanted? I don't get it... what was he suing for?
 
Maybe check billboard ordinance for your land. A very large Land for Sale sign along the property line might be in order. As a courtesy to the other neighbors maybe plant a line of trees behind it block the view of the back of the sign.
 
i would cut that grass weekly in a fancy sombrero just to see the look on his face.

hell i'd even put up a nice picket fence a bbq and some lawn chairs just to watch him cry.
 
Make sure to visit it every so often and have no trespassing signs so he can not claim it by other methods.

But yea I love sticking it to people that can't simply just talk to a neighbor first and use common sense.
I may have to sue a neighbor that has his driveway and fence on my land. My wife offered to take the fence down for him and we gave him a copy of the property lines (done by a certified person in our county). yet still has not done anything.
 
Barbed wire and whatnot along his property line, allow the "friendly" neighbors fair use. Be sure to throw a party honoring your dad annually there.

Yeah we really don't understand his thought process. At first he didn't want us to get the land because he thought we were screwing his mother over some how. She couldn't have afforded it at even a heavily discounted price so we don't understand this.

Then he wanted to stop the transfer so he could buy it - not realizing the other neighbor doesn't have to sell it to him.

Then he sued my parents after they bought it claiming they didn't have the rights to ownership - which they clearly did.

He also demanded we sell him the land at the price he wanted. Uh - yeah we don't actually ever have to sell you anything. He had three chances to get the land. First for fricken free if he hadn't been a dipshit. Then for what seems to be a pretty reasonable price since it would just be a proportional $/ft we paid which was heavily discounted due to good relations with the neighbors we bought it from + legal fees from his stupidity.

So sue again? Yeah the price is just going to keep going up if you make us spend more money to fight frivolous lawsuits.

I have considered planting trees. The environment is a precious resource and too many trees are being cut down on a daily basis
 
Set bear traps along that narrow path. Then set up some hidden trail cams. Post results here for even more fun !

+1 for vindictive purchase of property to screw over neighbor.

Stories like this are why it's important to not be a douche to your neighbors. Everybody would have gotten what they wanted if your neighbor didn't act like an asshole.
 
That guy sounds like a peach. If you are an adult and talk to people usually they are reasonable.
Case in point. 8 years ago i buy my home, first house in the country. They ask if i want a survey? Of course not! Its the country and the old school fences still exist on the property which lines up with how big i think the lot it.
Fast foward 5 years. Turns out when the family farm (my neighor and my house were kids of the old man) was divied up and sold off, the old man kept a strip so he could get access to the now non existant dairy barn. In a nutshell, i did not own about 50% of my drive way and roughly 1/3 of my barn. I only found out when the old man sold off the property to a son in law to hunt (120 acres). He got it surveyed and i came home to stakes in spots i didnt think they would be. Luckily he was super cool and knew about it and sold it to me for basically nothing + a case of beer. But i could have done the squaters rights, court deal as well. usually helps to be nicer though.

heh-heh...We have a dickhead neighbor who bitches about every-fucking-thing...most recently, he was bitching about my recently built, but as yet, unpainted garage. I showed that "cactus-vent" to my wife and suggested we should install one of those for attic ventilation in the garage...😛
 
Since things have already gotten this far, you might as well rub his nose in it. Send a certified letter, return receipt requested, that includes a map of that area and state that the purpose of the letter is to avoid any misunderstanding - he is not permitted to use or trespass on that land under any circumstances.

"Since all the disputes about ownership and transfer have been settled, I thought it would be a good idea to let you know what the final outcome was. The enclosed map shows the various property lines adjacent to your property and the two adjacent ones.

"To avoid any unnecessary misunderstanding, I am writing to let you know you may not use, traverse, or trespass on the L-shaped section which I retain ownership of. Of course, I will not trespass on your property either, so I believe we won't have any future disputes. It's regrettable we could not have worked out something different, but at least there won't be any further confusion."
 
Quick question but how will you get access to said property if it's surrounded by other land or is there some kind of public road / path to get to it?

You bought it from the new owners, or kept the L shape from the estate before selling?
No one in your family owns either left or right lots now?
So it's obvious you parceled the L off for future sale or to piss off the guy in back?
You could always say it's for sale to him or the next owner... after he dies of cancer.
