In California it seems to be almost a right of passage to kill your wife, get away with it, and sell the story.

Well see, he hasnt been found guilty yet. So they can't deny him the right to sell the story. And honestly, with the lack of actual physical evidence on the part of the prosecution, hes not likely to be convicted.

I think there is enough circumstantial evidence to convict but not enough physical evidence for the death penalty

circumstantial simply means there wasn't an eye witness. for example, if you see a guy run around a corner with a gun in his hand, then you hear a shot, then come around the corner and see the guy with the smoking gun in his hand and someone dead on the ground of a gunshot wound, then that is circumstantial evidence. it allows you to make an inference that the guy with the smoking gun in his hand committed the crime.

I'm just saying has to be more bite to the "evidence" other than hearsay or smoke and mirrors.

Personally, I don't think he should be tried for killing the fetus. After all, it's just a fetus, right?

hearsay isn't evidence.

often eyewitness evidence is more unreliable than cirucmstantial.
