Those T&C were still up on their site @ the time of disclosure.

Also, you have to notify changes like that.

Your comments presume that Kulich owns or runs that website, and is therefore bound by its privacy policy. Kulich claims on Twitter that he doesn't, but that he figured it out because Knox appears on that site. I have no idea if he's telling the truth, but that's his defense. Kulich also complains that most of the stories published about this are factually inaccurate, and that only Huffington Post got it right.
