Kazaa Conspiracy theory or just someone blowing smoke?

sounds plausible...but most likely improbable.

Kazaa is a product of the music and video industry. Napster was
not. Napster got crushed, Kazaa thrives. This is because Kazaa
was specifically designed to act as a means of entrapment to get the
music/video industry more money than they were making selling
official CDs/DVDs. Easy example - the average copyright lawsuit
has ended with a settlement of $15,000. That equates to the equivalent
of purchasing 1,000 CDs or DVDs. How many people have downloaded
over 1,000 CDs or movies? NONE. The music/video industry knows
this very well, so they set up Kazaa as a means to track and bust
copyright offenders to make more off the fines than they would have
made selling their products. Clever money-making scheme. This is
why Kazaa is a worthless site for getting music/videos and why
trading is more effective.

I think that is a pretty weak theory. I think the people of Kazaa were just smarter then Napster and used loopholes to avoid it being taken down

AFAIK the RIAA has lawyers on retainer. I think they pay for them whether they're litigating or not.

Well, they WERE losing money when it was at it's peak. And it was at a "peak" for a very long time, so that's a lot of lost revenue. And plus, they are settling a lot of cases for less money. If Kazaa was only out for a few months, and then they pulled this crap, I might buy into it. But it's been a few years.

Napster was made by an American. Easy to prosecute. Kazaa was not. In fact one of the programmers of Kazaa is the same person that made his own version of Subspace to avoid any legal issues. Smarter programmers I guess.

napster was made before anyone took notice by some uni students

Napster was run by a college student from California. Kazaa is owned by a company called Sharman based in the island nation of Vanautu which seems to be where several business people go when they want to avoid international litigation.

bleh. No way.

Besides, if they DID do that, and were caught at it, wouldn't it be entrapment? Not only that, but there would be a possibility that it could be turned to read that they had given up their copyrights and EVERYTHING EVER ON KAZAA would be in the public domain?
