Wow. This is a nasty business. Maybe the 16yo should be charged with something like negligence or something? It is partially her fault.

Not remembering what your favorite foods were at age 5 != not remembering killing another child and the surrounding police investigation.




If this child gets charged with anything it's an absolutely epic fail.

If you did kill anyone at 5 and you forgot, how would you know?

A normal 5 year old will know 'this is bad' or 'this hurts him'. may not have a concept of the permanence of death, but they know enough to not hold a baby underwater.
