Juvenille curfew

I live in Utah and was wondering about this juvenille curfew from 12AM-6AM. It says the curfew hours don't apply if I'm "exercising First Amendment rights protected by the U.S. Constitution." What exactly does this mean? If I was eating at Denny's and a cop asked me what I was doing out could I just say I'm excercising my right to assemble peaceably? Could Denny's refuse to serve me? Does Utah actually enforce this law? Just curious ..

what a stupid law. i guess you can be out at pretty much any time unless you're trying to incite violence

Those laws should not be legal, IMO.

But really, they're jsut an excuse so a cop can arrest kids without a real reason. If he sees a bunch of kids hanging around outside and he thinks it looks like they're going to start trouble, he can cite them for violating curfew, rather than waiting around until they actually do something and then citing them for an actual crime.

It's BS if you ask me. However, unless you're hanging around on street corners, nothing's likely to happen to you.

Well I'm not really worried about getting in trouble. I go out late at night all the time but I was curious about the law so I decided to look it up. It seems a little silly to me ..

I imagine it's redundant since cops have pulled me off the street and "questioned" me @ 3am citing reasonable cause etc.

I wrote a paper on this last term for my humanities class. Curfew Laws: Taking the Parenting From the Parents. In my research, I found that basically, as long as you are wearing a shirt or button or something that has a message, you can be out. You could even be wearing a button that says "Curfew laws are unfair". That doesn't mean the cops won't try to send you home, but you could fight it in court.

It is a stupid law. I think too many people my age (35) and older have convenient amnesia.
