Just got into a car accident... =(

Was sitting behind a car at a red light on the left lane... light turns green and the car in front of me is having problems... so i look at my right mirror and see an open lane and slowly change lanes... then BAM... some lady in an 86 Honda Accord comes out from nowhere and my front bumper gets ripped off while my fender scratches the Accord and dents it... :( Sad thing is i was driving my mom's car... a 01 Rav4... and not my POS car... another thing... my insurance just dropped because my last point was cleared after 3 years already. Technically it will be considered my fault... right? Since i was the one changing lane... even though for all i know... the lady could've come far from behind, changed lanes too since she saw an open lane turn green and just didnt see me changing lanes... guess odds are against me since i saw nothing :( i'm sure AAA will like to get money out of me too so they'll jack up my insurance rates again... sigh... the thing is... her husband told AAA that he was the one driving and not her... even though HE was not even at the scene until like 20 minutes later after she called him. The second lie is they said there were children in the car... even though i have 3 passengers with me that also saw that there was no one with her in the car during the accident. BUT... like i said insurance companies like to make money... :(

ah sorry, been through that... sometimes i see cars come from behind me in which i hadn't noticed before.. scares me. "wtf did he that come from?"

If she wasn't driving, and he didn't come till later, you need to make sure your insurance knows that. And you also need to get the three people with you to confirm that as well. If you lie to your insurance, you can get fuxxord.

Good to know you're alright and you weren't doing anything too stupid. Sorry bout the car though...

Thanks... that's the sad thing... i love driving and i love cars... but when i get into silly accidents like those where something so simple as a second look couldve avoided that... man do i feel like isht... :( i guess that's how it is when you're forced to not like something you love doing. :(

If anything... it will probably more like their neck hurts since it will technically be my fault unless some sympathetic guy at AAA decides to represent their client instead of trying to make more money out of them. :(

Yeah they know... but i doubt they'll do anything about since they'll say i'm at fault... blah... :(

tip,

keep a 35mm disposable camera in the glove box of all of your cars. If you get in an accident, get it out and take pictures.

Yep got that... so i got pictures of everything... sad thing is if you look at it... i got the worst deal since i was going slower than she was... :(

Yeah, you'll be at fault unless she wasn't looking or something - then you could both be found at fault depending on the state you're in. Make sure to follow Crimzon's advice too - who knows what could happen if the other driver attempts to make a fradulent claim. Did you have an accident report or just AAA?

You mean a police report? Nah... should've though... since the other party is now lying out of their ass... just called my insurance company right after i got home... :(

if they lie to the police, and make claims that were false, they will be commiting a felony. they can also be accused of insurance fraud. good thing you were NOT alone. the insurance company will go by the police report. just make sure you and your friends have descriptions and stuff that match.

Any chance you got pictures that show only the wife in the car/at the scene and no one else with her? If so, that could be a very big help, along with your friends stories of what happened. Good chance that with the pictures and the stories you can prove she is lying, which will could be a tremendous help on your side, and possible even found not at fault.
