just got an OCZ agility 2...undersized

OCZ says they are only shipping V3, but V2 have not been recalled and are still being sold by retailers.
 
ok, got the drive. had something like 107gb after format. Loaded windows, downloaded the OCZ toolbox and it says I have 64Gb die size. Is this an affected drive? If so, can I RMA it?
