Just got a speeding ticket

Well, I was just going back to school after getting my car, and a police officer pulled me over for speeding. I was in the right lane (2 lanes each way), and saw the police officer in an opening on the left side of the highway. I had my cruise control set for 70 mph, and cars were passing me. I saw him pull out, and thought he was going after someone passing me, but he got behind me.

After about a minute of riding my ass, he turned his lights on, and pulled me over. When he got up to my window, he asked for my license and registration. I asked him what I did, and said I was speeding, and walked back to his car. After a few minutes, he came back, and gave me the ticket. I asked him how fast the ticket was for, and he said 83 in a 65. I said to him I know I wasn't going that fast, but didn't want to tell him I had cruise set for 70 since that is still speeding and I didn't want to implicate myself. He said that's what he got me for and there was nothing he could do right now.

So once I get back to school I fill out the not guilty plea on the ticket, and sent it out right away Certified Return Receipt. Now my question is, when I get a date to make an appearance, what happens?

Right now, I have one other ticket from an accident that was beyond my control (car hydroplaned, went across 2 lanes of traffic, cop gave me ticket for unsafe lane changing. Plead not guilty, and still havent heard anything back, and this was 8 months ago).

I am told that the prosecutor will sometimes settle on a lesser charge if you have a clean record. Do I have a good chance of this. I accept that I was speeding (70 in a 65), but I know for a fact that I wasn't doing 83. If I tell the prosecutor this, will they not believe me, stating that the cops laser is infallible? I know either way I need to pay a fine, but will they change this to a no points infraction? I will still go to a defensive driving course, but don't want to get fvcked by insurance.

Once again, I accept the fact I was speeding, but I wasn't going 18 over, I was only going 5 over, so I really don't want to hear the people yelling "accept the consequences." I will accept the consequences for 70 in a 65, but not for 83 in a 65.

Cliff notes:
-I was going back to school
-Cop pulls me over saying I was doing 83 in 65
-I know I wasn't going that fast, because I had cruise set to 70, and people were still passing me (I was in the right lane)
-Filed the plea of not guilty, and sent it in
-What happens when I make an appearance X months from now?
-Have one previous ticket because of an accident out of my control (car hydroplaned, went across two lanes of traffic, got a ticket for changing lanes unsafely).
-Can I get this reduced to a no points infraction?

I had a friend who did a lot of work on radar in the Navy. Needless to say, he always got out of speeding tickets😛 It's all about knowing what questions to ask.

Being white and telling people you just came back from "such and such" operation in "country w/ terrorists" doesn't hurt either.

Still you should fight it. The price you pay in insurance as well as the ticket make the fuss worth it.

Look for a mistake. Maybe the cop won't even show. Sound like you've got a story to tell then all ready at least.

true, but it helps more when you get pulled over than when you're actually in the courtroom. Apparently slipping them a military ID is better than bribery😉

Well, I was going to try and find a mistake on the ticket, but this cop had one of the new ones that is all digital, and printed in the car, so he enters your license info, and plate number, and ticket prints itself. I am gonna fight it, but was just curious what happens when I do.
 
What kind of car do you have? How old is it? Any info about speedo inaccuracy for that year/make/model or cruise control issues? Do you have different sized wheels than what came on your car?

2001 Ford Escape. No issues that I know of. But if a speedo is 13 mph wrong, then I would notice if I was driving say 30, and people were riding my ass because I was going 17, you know? Plus I know when driving a certain speed what it feels like.

No, everything is stock except tires have been replaced when worn. Stock rims.

Hmm, I dunno.. your car isn't that old.... I know my first car was off quite a bit, but it was 15 years old. Check to see if you can find any information about issues with the speedo or CC on your car... maybe take your car to the dealership and have it calibrated.
 
Also... since you dont have any previous speeding tickets, my suggestion is to hire a lawyer. Most likely, he can get it reduced to Improper Equipment.
I got a speeding ticket in NC once, and the cost of hiring a lawyer was cheaper and easier than paying the ticket. Chances are you'll get a bunch of crap in the mail from lawyers saying they can get it dropped. Pick the cheapest.

In my experience, most cars read 2-3MPH fast. I'd imagine 13MPH would be QUITE noticeable. Still, the OP might want to consider going on the freeway, setting the cruise control at 60MPH, and timing a few miles with a stopwatch. It should be within a few seconds of 1 minute for each mile.

Or get a friend to drive behind him and see what his car says 🙂 And yeah I agree with the 2-3mph for most.. my first car was off by 7-8mph tho. I was too cheap to get it calibrated back then 😀

I'm not posting to argue that ticket. So please don't talk about what you don't know (I have already consulted lawyers about that ticket, and don't need your opinion on it).

I do know about such things because I got a ticket for it. Deserved it too. I only brought it up because you made a big deal about how it was beyond your control but the judge might not see it that way. Just something to think about. You really don't have to get all sensitive about it.
 
Instead of saying your cruise control was set for 70, just say it was set to about 65MPH and that you are saying 'about' because you have a hard time getting it to stay EXACTLY at X speed. Sounds better in court, I'd say. 😛

EDIT: Also clarify that you know for a fact that you couldn't be doing 83 because your cruise was set at 65, give or take a couple MPH. I guess uncertainty might not get you out of the ticket, but maybe it'll reduce the fine.

I had the exact same thing... got a ticket for doing 120kph in a 100. I was actually doing 110. Hired Xcopper (traffic lawyers) and they had it completely dropped. Cost me a $300 instead of $100 for the ticket, but the insurance savings made up for it BIG TIME.
