Judge: Man Is Too Short for Prison

SIDNEY, Neb. (AP) - A judge said a 5-foot-1 man convicted of sexually assaulting a child was too small to survive in prison, and gave him 10 years of probation instead.

His crimes deserved a long sentence, District Judge Kristine Cecava said, but she worried that Richard W. Thompson, 50, would be especially imperiled by prison dangers.

"You are a sex offender, and you did it to a child," she said.

But, she said, "That doesn't make you a hunter. You do not fit in that category."

Thompson will be electronically monitored the first four months of his probation, and he was told to never be alone with someone under age 18 or date or live with a woman whose children were under 18. Cecava also ordered Thompson to get rid of his pornography.

He faces 30 days of jail each year of his probation unless he follows its conditions closely.

"I want control of you until I know you have integrated change into your life," the judge told Thompson. "I truly hope that my bet on you being OK out in society is not misplaced."

Good to know that prison has a minimum height requirement.

That wouldn't have happened in the US. Nope. Here you have to be "Too pretty to survive jail" to get probation.

Well it happened it Nebraska (see OP). What a messed up decision. Nobody should get a free pass simply because they're short.

Well it happened it Nebraska (see OP). What a messed up decision. Nobody should get a free pass simply because they're short.

Well, the liberal senator got a pass in the death of a woman and his son got a pass in the accident he was involved in, twice.

No problem------we just need to segregate jail inmates by heigth and weight----send the guy to midget prison---and better make sure the bars are placed a little closer together.
Would not want the guy to be so small he can wriggle between the bars---or walk under the door.

And someone needs to give the judge a very big dope slap---like in removal from office.---I am sure the good people in Nebraska can figure out something.

No kiddin, the man could be parplegic, and he deserve to be raped in jail as well. Man, the judge should go with him too with that decision.

IF it is accurate its an outrage. But I want to hear some more about it because it sounds ludicrous that a sane judge would do this. Although there are wacko judges. And last I looked Nebraska was solidy a Red state.

Judges don't have to follow the will of the majority. You don't think that state has one liberal whacko cause someone gave it red paint? I?m fairly certain there are all sorts of crazies in every state regardless of what the majority is.

What do you expect from Nebraska? I live here, they are mostly idiots. Have sex with your wife that you married legally in Kansas? Of course not! Go to jail, do not pass go, do not collect $200. Molest a child? Sure, you can do that and walk free if you are too short to be any good on the football team.

Recently read followup article on the yahoo news------it appears that some in Nebraska--including the States AG--will make an effort to override the judges decision--and make sure shorty is not
deprived of that prison time he quite properly has earned.---even the ACLU thinks its a traversty and a mis-carriage of justice.

But it does still ignore that practical decision------after all--prison is where society punishes itself at a cost of some 20-30K bucks/ year--to place some human who is a sort of fraction defective--so we get them off the street
where they cease damaging us normal humans. ---the least we can then do is make sure that they don't then damage their fellow inmates. That should not be asking too much--regardless of height.

Putting them in iron cages and feeding them bad food is part of the bargain---routine sodemy is not the punishment any just society should permit. When the latter becomes the expected reality---we must examine ourselves.

One wonders what he actually did. I do not under any circumstances condone child molestation (duh!), but this may have been a relatively minor offense.

Did read that this involved sex with a 12 year old girl-----a crime in any State I know of-----little young for age of consent. Regardless of any other circumstances.

Oh--and to Moonbeam--glad to see I am promoted from total idiot to a human being---although many toss labels around like popcorn.
