Judge Allows Civil Lawsuit Over Claims of Torture

Mr. Padilla was held as an ?enemy combatant? in solitary confinement for more than three years in the Navy brig in Charleston, S.C. Mr. Padilla, who was convicted of supporting terrorism and other crimes, demands that Mr. Yoo be held accountable for actions that Mr. Padilla claims led to his being tortured.

During the time Mr. Padilla was held in the brig, according to his filings in the case, he ?suffered gross physical and psychological abuse at the hands of federal officials as part off a systematic program of abusive interrogation intended to break down Mr. Padilla?s humanity and his will to live.?

In the 42-page ruling, Judge Jeffrey S. White of Federal District Court in San Francisco characterized the conflict as one that embodies the tension ?between the requirements of war and the defense of the very freedoms that war seeks to protect.?

Mr. Yoo, as part of a senior administrative group called the War Council, helped to shape Bush administration policy in the war on terrorism, and as deputy attorney general in the Office of Legal Counsel from 2001 to 2003, wrote many memorandums authorizing harsh treatment. Mr. Yoo had argued that he should be immune from the suit because it was not clearly established that the treatment would be unconstitutional.

Withholding evidence and information in regard to criminal behavior with preposterous opinions written to circumvent the law and provide cover for illegal administrative policy must be punished.

Every action must be taken, civilly and criminally, to stop this outrageous behavior in the future from ?super-loyalists? who hide behind executive privilege while violating their Constitutional oaths and writing opinions to fit disgusting administrative guidelines. Let this be a warning:

The treatment of POW/EC has been condemned internationally, and defies our own 4th, 5th, 6th, 7th and 8th amendments. The Constitution can't be parted out to protect gun rights, but not protect other civil rights.

As such, he was held in solitary confinement in a Navy brig for more than three years and deprived of his Constitutional right to habeas corpus, his right to legal counsel and his right to a speedy trial in open court.

In and of itself, that is sufficient to raise Padilla's suit far above labels like "trivial" and that the evidence should be presented in open court.

*IF* you believe the Bushwhackos commited no acts of torture against ANYONE, or *IF* you believe they broke no U.S. or international laws, there there is no reason or legal barrier to prevent any other American citizen from being designated as an "enemy combattant," imprisoned without cause or proof, deprived of his rights and becoming another victim of TORTURE by our government.

*IF* that is what you believe, justice would be served if YOU are that next victim.
