Jones Act and the BP mess, I hope this isn't true

I reading on another site and a member posted something about the Jones Act that prohibits ships which weren't built here or which aren't manned by Americans from operating. The POTUS states can waive this and Bush did right after Katrina, and supposedly the Dutch offered to send some ships that could skim 20,000 gallons a day but were denied.

It's true. A lot of aid from other countries has been turned away. Obama refuses to waive it to protect the unions.

The spin from Gibbs has been amusing though.

It appears to be a red herring, another faux-outrage attack against Obama. Spidey knows this since he's posted in that thread, but presumably bumped this one to perpetuate the misinformation. The Jones Act has not yet been waived because it doesn't apply. Contrary to Spidey's claim, there are quite a number of foreign vessels already assisting in the clean-up effort. The Jones Act doesn't prevent this at all. Further, if a circumstance arises where a Jones Act waiver is necessary, they've put an expedited waiver process in place so it can be quickly and automatically approved.

Spidey said it, not Bold, 80% sure not True. Hell, there's hardly a Union large enough to be protected, never mind benefit from this spill.

The Obama Administration turned them down because they were not 100% efficient and small amounts of oil would be pumped back into the Gulf with the excess water. EPA regulations do not allow for residue water to contain any oil. So rather than use equipment that was not 100% efficient the Obama Administration chose to let all of the oil run into the Gulf."


"The U.S. Government has apparently reconsidered a Dutch offer to supply 4 oil skimmers. These are large arms that are attached to oil tankers that pump oil and water from the surface of the ocean into the tanker. Water pumped into the tanker will settle to the bottom of the tanker and is then pumped back into the ocean to make room for more oil. Each system will collect 5,000 tons of oil each day.


One ton of oil is about 7.3 barrels. 5,000 tons per day is 36,500 barrels per day. 4 skimmers have a capacity of 146,000 barrels per day. That is much greater than the high end estimate of the leak. The skimmers work best in calm water, which is the usual condition this time of year in the gulf."

"As of June 8th, BP reported that they have collected 64,650 barrels of oil in the Gulf. That is only a fraction of the amount of oil spilled from the well. That is less than one day’s rated capacity of the Dutch oil skimmers."

Admin also turned down a British offer because of paperwork.

No need for waiver when the Feds turn down offers from other countries to send the boats in the first place.

Out of curiosity, is there a reason that they don't proactively waive it anyway instead of putting yourself in a position of having to be reactionary? Is it something that has to be done on a case by case basis or can the president completely waive it so that no request at all needs to be made?

Why does Obama refuse to break the law just this once? Something to do with that crappy Constitution where he has to follow the laws the Congress passed?

The jones act would not apply the skimmers as they can be attached to any tanker. However, I read the epa rejected the devices because they would put oily water back in the ocean. Not sure if that is true or not, but sounds like something that would happen.

I tried to give Obama the benefit of the doubt, even supporting his moratorium on new drilling until I found out that they had added that to the report AFTER it was reviewed and that it went straight against the recommendations of the very experts they were consulting. But it's getting very hard to believe this is merely incompetence. Not even a community organizer could be this incompetent AND manage to also surround himself only with people who are also this stupid. It's getting hard for me to suppress my natural suspicions that Obama wants this to be as devastating as possible to pass glorious new Cap and Tax bill.

Granted, he did get that $20 billion escrow account he wanted from BP, so maybe it's mostly just honest incompetence. Now to see that he doesn't put the management of Fannie Mae or ACORN in charge of it and turn it into a political slush fund . . .
