Los Angeles City Attorney Rocky Delgadillo, whose office prosecuted Brown, said the sentencing was a victory for victims of domestic violence.

"This is a triumph of common sense over legality," Delgadillo said. "The appellate court has now exclusively supported our position that vandalism, in the context of a domestic dispute, is domestic violence."


To add insult to injury he bought the car for her.

 
So if I get mad at my wife and walk over and kick the couch(not really my style), I have now committed domestic violence?

  • That's a long damn sentence for misdemeanor vandalism.
  • She is a twit and ought to be charged for filing a false report.

I assume he did alot more than just kicking the car,although I disagree with vadalizing a car being the same as being domestic abuse.

In any case he had a chance to stay out of jail by going to counseling and paying a fine but he chose to fight it.He lost and is now going to jail for 6 months big deal

If you rip the couch to shreds or break it as an act of intimidation then I'd say so...

Also, his wife said he threatened her life...but changed her story later. I know most of you are thinking she just made a false report, but maybe she just decided she wanted to protect him?

My friend's father attacked her once because of an argument, they called the cops and got him a night in jail, but they dropped all charges after that cause she didn't want to send him to prison or whatever. That DOESN'T mean that she wasn't attacked.

Even an old Jim Brown would have done serious damage if he physically threatened this woman . . . look at the picture . . . she's Super-Sized meal short of 100 lbs.

He shouldn't have to take a bad deal versus a worse deal! LA County is trying to get the man for losing his temper and vandalizing his property. Call it his wife's property if you like . . . then she would have to file charges of vandalism. That's a long way from domestic violence.

He threatened her life but the DA can't make a case for assault. Oh maybe he verbally threatened her . . . then ran out and assaulted the car . . . while she called the cops. What did he go outside for . . . to get enough courage to go back in and hit her? If her life was in such peril that she called the authorities and could communicate that she feared death . . . where was Brown? Oh yeah, he was outside taking out his anger on his automobile. She needs to protect him; he's the breadwinner . . . and she needs a new ride.

I was thinking the same thing . . . about intimidation. I believe in giving domestic batterers just enough rope to hang themselves but most have a record. There's always a first time but it's usually not an old guy. Fudged-up applications of the law protect no one and harms us all.

But, this speaks to the notion that we can discern intent. That might not be so easy to prove, you know the whole, "What lurks in the minds of men".

My thoughts exactly. I'm sure couch-kickers are more likely to be domestic-abusers but you can't put someone away because they *might* commit a crime
 
Yeah, but the DA is not accusing him of a presumed attack. The DA's case is that Jim Brown assaulted her car after their dispute and that qualifies as domestic abuse for which he should pay court costs, serve probation, pay/attend domestic abuser classes.

 
um, i think this law is stupid. before, people were like "well, i'll just beat some object instead of my wife" now they'll be like "well, i'm gonna get in trouble either way... might as well beat my wife"

Is no one else highly disturbed that this came out of the DA's mouth? Not only is he saying that the current laws don't conform to common sense, but that this 'common sense' is now superceding those laws. Actually, disturbing doesn't quite cover it, this is down right scary.
 
It's poopy. Common sense has become the watch word of the 21st century. Everybody claims it b/c everybody supposedly knows what it means. But it doesn't mean jack. It's the refuge for the ignorant that can't argue facts or in this case the law.
