Jailbreaking with 3.1

I bought a used iphone with 3.1 already installed on there, and from what I've read if it wasn't previously jailbroken I can't do it anymore?

Is this true or is there any way around this?
 
This is true. You can't jailbreak 3.1.

But you can downgrade to 3.0 and then jailbreak it then. There's not that much to 3.1, so as long as you want to jailbreak more than you want the few new 3.1 features, it's a good way to go.

While you can downgrade 3.1 to 3.0 to jailbreak, you can't downgrade the baseband (the communications CPU's firmware), so once you have upgraded to 3.1, you can't unlock the phone (until they release the 3.1 unlock one of these months).
