heres the story
ive got a friend(girl) who got herself into some financial problems with ex-loser bf.

this is what she emailed to me:


Here is my story.....

I dated this guy for about a year, when i met him, he was all that i ever wanted(well it's always like that in the begining). Well, he found this job, needed help with money, and thinking that since we were in love and may be getting married, i thoguht i help him get a few grand loan...stupid did i know, he couldn't hold a job......

few months later he cheated on me because i wasn't there for him cause i was too busy working for money to pay for bills......then he turns **** around and blamed everything on me....

now, i'm left with this loan to pay, and he's not helping me....just the other day i contacted him and he refuses to talk to me, he yelled at me and said why did i write threaten letter to his mom's house.........i want to take legal action and sue his ass, but i know that if i do that it will be endless.....knowing what type of guy he is....

any suggestions


what do u guys think she can do. anything she can do legally

tell her to go talk to a lawyer.

it's probably better that she does it sooner than later.

Depending on how much the loan was for, she can take him to small claims court for the money, I guess.

Unless they had some sort of repayment agreement (on paper would be even better), she's probably screwed.

If she took out the loan in her name only, and there's no written agreement between the two of them, kiss it goodbye. It will be her word against his and that's not going to fly.

If she already knows that pursuing legal action will be an endless source of grief, she needs to figure out whether she is willing to go through the aggravation in order to get her money. There's no way for her to recover it without an investment of time and aggravation on her part.

Her options are pretty limited from a legal point of view, IMHO.

Thats not true...I was watching peoples court one day ( I was bored) and they were airing this one case with the girl in the exact same situation. The judge ruled in her favor as both of them understood that it was a loan, not free money. A verbal agreement is all that is needed. Just as long as she has the cashed check, or some sort of receipt to show that she actually loaned him some money she'll be fine.
