It's a civil lawsuit. Damn you fuckers are ignorant.

"Based on her findings, James has the authority to file a civil lawsuit but cannot pursue criminal charges — in other words, if any of the Trumps ever end up behind bars, it won't be over this. James is, however, also involved in a criminal tax-avoidance investigation into the Trump Organization led by Manhattan District Attorney Alvin Bragg.

After receiving his subpoena last month, President Trump filed a lawsuit contending that James' investigation was "guided solely by political animus." The lawsuit, to which James' office has not yet responded in court, also claims that any testimony the former president gave in the civil inquiry might then be used against him in the criminal investigation, thus violating his Fifth Amendment right against self-incrimination."

If subpoenas even in a civil inquiry can be routinely ignored then there would be no point in serving them. You bet if my black ass ignored any subpoena issued by the CJS it would wind up in jail.

I guess you don't really believe in the rule of law. Then again, all of us already knew that.

Damn.

Nice loophole. Cant believe noone thought of that before. So basically anyone under criminal investigation can pull this on any civil lawsuit. Thats gonna be some nice precedent.

No, it’s a civil investigation, and the NYS AG has subpoena powers for those as well.

Damn you’re ignorant, lol.

Help me understand something. I thought the issue here regards Trump's older children testifying under oath, not him. So how is his right to take the 5th compromised by this?

Doesn't the fifth amendment also apply in a civil case? In a wrongful death suit it doesn't seem like admitting you shoved a knife in a guys eye would be a good idea.
I honestly don't know the answer.

The 5th amendment always applies, but claims of blanket immunity from testifying never apply. Trump can be and will be forced to give testimony but when he does so he must elect to invoke the 5th amendment against every individual question. In a civil case deciding to do that has consequences though as under New York law the jury is allowed to draw negative inferences against you for doing it. (ie: if you're invoking the 5th that means the plaintiffs are right about how your conduct was bad/illegal/whatever)

So basically the Trumps can invoke the 5th if they think it helps them get out of prison but it also makes it easier for the NYS AG to destroy the Trump Organization.

They aren't ignoring it. They filed a motion to quash the subpoenas. I don't think it will fly. The conduct being investigated carries both civil and criminal liability, and as mentioned above they can assert 5th amendment privileges when being interviewed for the civil case. As for anything Trump related, they are going to stall as much as possible and appeal in any way possible and it will come down to the courts to order it and eliminate any avenue of escape, eventually.

Yes, as always I suspect the goal here is not to win but to delay for as long as possible.

The courts have really exposed a weakness where well resourced bad faith actors can gum up the works for years with no expectation of winning on the merits.

Yet another example exposing the fallacy conservatives are for the rule of law. Equal treatment under the law really means equal treatment if you have enough money.

Laws for thee and not for me, how Trumpian, how aristocratic, how Republican.

Yep, use wealth and power to delay, erode and escape accountability. Wait for the next election and then pardon the inner circles.

Must be nice to be an elite where laws and taxes become optional.

It's a civil lawsuit. Damn you fuckers are ignorant.

Tell us again how the Republicans are the party of the working man when it's run by, and for the benefit of the lawless aristocrats, elites, oligarchs, and wealthy grifters.

I generally agree but tend to doubt it will work here as there's no election that will save them. Like what, is the next NYS AG going to be less hostile to the Trumps? Unlikely. Is the next governor? Also unlikely. They are just super exposed in New York State because their business is centered there but the politics of the state are implacably opposed to them.

I guess they could hope for a Republican to capture the White House and then try to starve NYS of federal funds until they stop the investigation but that seems difficult to do and also is at least three years away, which is probably too late for them.

Yes, of course federal pardons have no power against state charges, and they may be finally cornered.... But they've led lives of crime for generations now and I'm skeptical that they will finally face accountability.

How many times have we thought this?

Trump U? Nothing
Florida? Pam Bondi
Mueller? Dud
Impeachment? A joke
All the rape/assault charges? Buried or severally delayed.
Jan 6? Only pawns are in prison.

This list is far from exhaustive.

Even look at the loyalists. Flynn. Stone. Bannon. Etc

No one who matters is held to account in any meaningful way.
Imprisoning patsies is no justice.

I'm not too skeptical, I think the odds strongly favor it. As I've said before there's one crucial difference in NYS - it is politically convenient for the people in power to go after Trump.

Sure, but what does that even have to do with the topic of the thread? Whether it is civil or criminal has no impact on the validity of the subpoenas or the Trump children's requirement to comply. Was taj just having a stroke or something?
I would say taj was havinga brain fart....but we all know Taj has no brain....
