Real Estate Investments, Inc. owns and manages my dad's office building. My dad agreed to lease the building for five years and entered into a written lease agreement with Real Estate Investments, Inc back in 2005. Here's the thing...under the lease,He was obligated to pay all of the utility costs of the building during the term of the lease. This year my dad wanted to split so he asked the company to modify the lease to provide that utility costs will now be split equally between him and Real Estate Investments. Real Estate agreed to this modification back in january, but later decides it does not want to share in the utility costs and refuses to pay.

welll my question is that, isnt landlord bound to its agreement to share utility costs?

my dad and I ..well i am helping my dad take this matter to the court if not resolved.. i am researching online.. like what rules or law apply.

any help be appreciated. thanks!

If they didn't agree in writing, then they didn't agree. Your dad can seek legal redress, but the outlook isn't good.

well they did modify the lease and agreed but this month they are refusing to pay...

If the lease states that they will split the costs, then that's what they have to do as long as it's signed by both parties and everythign is in order.

Call up alocal lawyer and ask. Usually they'll give you a quick opinion with no charge on something like this.

Post the exact wording as it shows on the lease if you have it available. Does it say specifically when they will start paying?
