I bought a PC peripheral online that was described as brand new, but I got what looked like a returned item with signs of use and not in the same packaging as described. I called them up and told them they need to send me a return shipping label and exchange itas for it was 100% their negligence.

They said "fine, just put it back in the envelope you got it in, tape it back up, write "return to sender" and drop it in a blue mailbox". USPS said once the item is opened, I can't refuse it. I told them what postal service told me. They said "don't take it to the post office, drop it in the mailbox instead".

My understanding is that "return to sender" or "refuse" is only for items addressed to previous residents, incorrectly delivered, or you do not want to accept it and not for returning merchandise.

Isn't this postal fraud?

Send the emails, talking about the return shipping, {and the complaint for used sold as new}
"Full Header" to your States Attorney General, and the "companies" State Attorney General,
along with CC to the USPS, and the company.
