Isn't selling game demos illegal?

I saw some ebay auctions in the past selling game demos. They were being sold for ~$2-4 + shipping. The auctions said that it's for people who don't have broadband and can't download them. I thought selling Demos was illegal, or it's not?

they are charging for their time making the cd's. It is legal. Same thing with shareware at computer shows.

Exactly. At $50 per hour labor charge, and 1 hour to burn the cd at 1x I can legally sell copies of Windows for $50+.

AFAIK, it is not legal most of the time, unless they have permission from the company distributing the demo. I guess it depends on the fine print...

I think they can but the user must be aware it's available for free
