Isnt passing bad checks a crime?

Where I live a passing bad check is a crime, a felony. You will go to jail.

Apparently our political class can get away with it.

CINCINNATI - The election is over, but many campaign workers had problems getting paid.

People who worked for the Ohio Democratic Party's office at Jordan Crossing said they did not receive checks they were promised, and others said that their paychecks bounced.

When some people are above the law why are you and I are expected to uphold the law?

I'm not sure where you live, but generally no, it's not. Writing a bad check is only a crime if the person doing it intended to defraud the recipient. I am not aware of any evidence of that in this case.

Just think about it rationally, do you think anyone would support a law that was carting absent minded old grandmothers off to jail for writing a check from the wrong checkbook?

Yes it is a crime. But usually a person will only be prosecuted, if they are habitual or it is blatantly egregious.

An essential element of most crime is Mal Cor... (can't recall the exact legal term atm). In other words, One can write a 'bad check' and there are civil and criminal remedies applicable IF the elements of the civil and/or criminal remedy are found. As I recall there is also a dollar limit twixt misdemeanor and felony (100.00$ I think it is) but depends on the State, of course.

"Passing bad checks" consists of intentional fraud using a checking account which isn't yours, NOT writing checks on your valid account if it is overdrawn.

That's "bouncing" a check, not "passing bad checks."

I never took you for an hysterical bitch and a stupid one at that. Please don't make me change my mind at this late date.
