I think the reason they do that is that it covers them from liability for copyright infringement. Also, it probably does save them quite a good bit of bandwidth.

Yes, they are. In fact, that would be in violation of the TOS of most sites to do that. Specifically, it is a problem because it removes any ads and other content from the visibility of the user.

sorry I just edited my post. they don't play the video embedded in their webpage so that does by pass some of the issues here.

A little, but not really. If the download link is supposed to be visible only to those viewing your page, then it would be wrong. Granted, it is fairly easy to prevent that, but it is still taking without asking.
