Is ticket scalping on eBay illegal?

Say I buy some tix to a concert I KNOW will be sold out. Is selling them on eBay after the sell-out and for more than I paid illegal?

provided you didnt KNOW the concert would be sold out, and provided you were not selling them to make any planned profit, no.

Scalping tickets is illegal, period. I don't think eBay is going to be any different in that regard.

How can tickets for the Michigan / OSU game be sold for $500-600 a ticket on eBay then?

on ebay, as long as you up a disclaimer saying how much you bought the ticket for and will not accept a certain amount of money its ok. lets say you put a disclaimer that says you bought the tix for 500 bucks. they won't stop you from selling those tickets then.

Not true, it depends on local laws.

On a side note, scalping should NOT be illegal. It's a simple supply/demand problem, the venues obviously need to raise their prices if there's a market for scalpers.

ebay can't police every auction. I thought for ticket sales, it depends on which state you were in.

I ran into issue a while back when I was trying to get rid of of DMB tixs that I couldn't use. My buy it now price was $8 over face value...I was reported to ebay and my auction was canceled. BTW the $5 was for Ticketmaster cost. I hate TM.:|

Can you skirt the rules by including the ticket in a "package?" e.g. Ticket plus a cheap ass item (like the way that NewEgg includes a bogus piece of hardware to sell OEM stuff).

Scalping isn't illegal in here in TN. The only restriction that I know of is that you can't sell the tickets directly in front of the venue, but you can do it across the street and down the block, etc...

its legal in selected counties or cities in OK.
im pretty sure its legal in norman, OK...where Univ of Oklahoma resides.

nah you have to say you bought the ticket for 400 bucks and you wont accept more than 400 or even +10% for the tickets. that way you can accept up to a 400 dollar bid for your 60 dollar ticket w/o ebay removing your auction

how can scalping be illegal? people walk around everywhere selling tickets near concerts/sports games, and police dont do anything.

i wouldnt' be worried.

Ryan either didn't read the above posts, or is just clueless.

I don't know Ebay's policy though. But I do know that there are tons of tickets on sale at ebay for far over face value with nothing else included in the deal. I was looking for tickets for the Oregon v Michigan football game a couple months ago and they were going for 500 or more on ebay.

I know that in Eugene, OR scalping is illegal. But it is really only enforced right around the stadium.

i guess, you could be bidding on the cheap item and getting the ticket for free.

Scalping is legal in AZ. We have ticket scalping companies. I bought great AZ Cardinals seats once for $100 a piece. Face value was $55. They advertise in the paper. Completely legal. Must be the anti-MP3 zealots that insist that it's illegal.
