Is this moving violation fine a little excessive?

A co-worker told me that she got a moving citation for not stopping at a crosswalk with a pedestrian trying to cross the st. She told me that she did NOT see any pedestrians waiting to cross but the cop disagreed and issued a moving citation.

The fine was about $821 dollars. Isn't that too excessive?

It might be excessive, but pretty much anywhere in CA (or even the US for that matter) the pedestrian has the right of way at crosswalks when there isn't a signal.

A lot of things can construct the view of a pedestrian. If the law were that pedestrians had to watch for cars, there would be a lot less pedestrian deaths.

The second that the pedestrian steps into the crosswalk you must stop, the fine seems a bit high though I would think $300 max.

I bet she was in a school or construction zone. Even $400 sounds expensive for that unless he tacked on reckless or careless driving.

That seems very excessive. Typical ticket for that around here is $175. I'm strongly in favor of the law, but $821 seems more than a little ridiculous, especially if it was an innocent mistake.

$821 is quite excessive. Geesh, in some jurisdictions you can run over a pedestrian and get fined less than that.

That seems excessive but I remember when I was in Cali last year in the Mountain View/Silicon Valley area there were traffic cameras on several intersections and fines were posted as being in the $300 neighborhood for running a red light. Where I live they're like $75.

That is high, but it also seems consistent with the gravity of the offense. Hitting a pedestrian who is crossing the street is likely to result in death. Most other traffic offenses are not likely to result in death. Still, I think it is excessive.

It's California. My friend got ticketed for Jaywalking, went to court, got it appealed, and then walked out of the courthouse and got ticketed again, right there. They just love their laws and their tickets.

Yes, it's true.

I got into an argument with a cop once. According to him I was apparently parked 19" away from curb and that warranted a ticket. I of course argued that it wasn't possible for him to tell the dfifference between 18" and 19", but being the authoritAH that he was, he insisted on being right. It wasn't until I pulled out a 12" ruler and showed him that it couldn't have been anymore than ~14-15" that he shut up and left.

There is a hard line against crosswalk violators in The Greater Bay Area due to the large number of fatalities of pedestrians by people who" didn't see them".
She should consider herself lucky that no one was hurt in her carelessness.
Chances are pretty good that she was talking on a cell phone at that time , I'll bet. Wait until they start enforcing THAT law next year......

BTW, the law states that when they(the pedestrian) leave the curb until they reach the other curb, no car shall enter the crosswalk, period.
In Oakland, they will set up a sting to catch creepers, who wait until the pedestrian has passed the car but not yet reached the curb and nail the offending driver.

City gets to regulate the fine.
Fines are designed to get your attention and cause one to reflect on the offense. OH and not do it again.

My aunt got that same ticket. They are pretty strict about it, but i wish there was a cop around when i was walking across the street and some lady in a mini van who had to yield to oncoming traffic just turned and almost hit me and 5 other people.

Those are some pretty hefty assumptions to be making.

Beyond that, while I generally support laws protecting pedestrians in crosswalks, I have little problem if a car starts traveling through once I've walked past it.

What assumptions are you alluding to? the part about the detail of the law or the cell phone?
As for what you're comfortable with, that has no bearing on this thread. This thread is about the fine for intruding into a crosswalk while pedestrians are in it.

I know exactly what you mean. $821 sounds excessive though. I know a few people in Berkeley who have gotten that ticket, and it's outrageous. I'm scared sh!tless driving here sometimes to see everyone pulled over. I nearly had a heart attack the one time I was pulled over when the light to illuminate my license plate blew out.

Mind telling me which street this occurred at?

This is why I'm against NEW immigration , drug, gun , etc laws, while the ones we have aren't enforced
