at my high school, it is very easy to get onto the roof. if, say, the cops came when i was on the roof, could i get into any sort of legal trouble? there arent any "no trespassing" signs.. this is a public school. public grounds, etc. how does this work?


secondly, this came up last night when i was talking with my friend. we were driving in the high school parking lot, and we saw a window open. would climbing through the window be considered "breaking and entering" (not breaking, because it's open, right?)? what could they cite you for if you climbed through the window into the school?

neither one is a good idea, don't expect to get out of trouble with the excuses "there's no signs"

it's fun to just sit up on the school roof and talk (im not saying i have... :)) and i wouldnt want to get into the school. that was totally hypothetical.

Well, access to the roof is usually behind some locked door or ladder in a "forbidden area". I doubt you'll be taken away in handcuffs if the cops see you. Most likely, your school will conduct some sort of disciplinary action.

Good luck trying to convince the authorities the roof of a school is a "public place". Think about it - these days anything that smells of potential terroristic activity is going to be dealt with harshly. Someone sees you on the roof of a school, their first thought isn't going to be "Oh, look, someone's sitting up on the roof talking."

If you can get suspended permanently for bringing a tylenol and plastic knife to school think what will happen when you are arrested on school grounds for criminal tresspassing....

Schools usually have a sign posted somewhere on the grounds that states that it is illegal trespassing to be on school grounds during certain hours... usually like 10pm - 5am or something similar.

Oh. They'll just call teh cops and have you arrested for trespassing if its not during school hours. The school is not public property. I can't just walk into any random highschool and open a pr0no store.

It is illegal. Someone tried it at my HS back when I went. There was a door or something up there that led into the Gym. He went in and tripped a silent alarm. Police came and arrested him. He was expelled (I believe) and brought up on criminal charges. Pretty stupid if you ask me.

oh nice.

people go on the roof of my school all the time. i know people that have been on the roof of the school being BUILT (under construction)

you can get up from the outside of the building, or through the inside. obviously, at night, one would go from the outside. people sometimes even skate on the roof.

Its just a public school. When it closes its closed. The city owns it.
Public school just means its a school for the public. Not open grounds where the public can
hang out when it wants. Its just a building owned by the city. So the city decides the hours.
Can you go to the library when you want. Can you go to city hall when you want.

Heck you cannot go the beach when you want. Alot of public beachs do not want people there after
sunset and will call the police if they find people on them.

As for the open window. Your kidding right.
If the front door to your house is open. Can I come and and just hang out. Take a nap in your house.
I mean the door was open. Think about it. Just because there isn't a sign telling you that your not suppose to
do something that doesn't mean you can.

Wrong. Most statutes define "breaking" (as in ... and entering) as breaking the closed space, not breaking a window, door, etc. The window is obviously not intended as an entrance, so if you use it to enter the building at an unauthorized time, you would be guilty of breaking and entering the building.

During regular school hours, going on the roof is probably more related to school rules than trespassing. Being on the property at other times may be covered by school rules and trespassing laws. What the authorities would do about it is up to them.

Bottom line -- If you know it's wrong, don't be suprised or pissed at whatever those in charge do if your caught. You knew it was wrong when you did it.

I bet there aren't any signs either that read: "No vandalism"; "No Littering"; "No Speeding"; "No Murder"; "No Stealing"
