Here is what he wrote:
HI I AM HAPPY TO HAVE YOUR SERVICES HERE ON AMAZON.COM I HAD A QUICK QUESTION IS IT OKAY IF I SHIP YOUR ITEM OFF AFTER 14 DAYS BECAUSE THATS WHEN AMAZON SAID THEY WILL BE ABLE TO CLEAR THE PAYMENT THAT YOU PAID I AM SORRY ABOUT THIS MISTAKE I DID NOT KNOW THAT AMAZON DOES THIS WHEN YOU FIRST SIGN UP I USE EBAY MOST OF THE TIME I JUST WANT TO BE SURE THAT I RECIEVE THE PAYMENT FROM YOU IF THATS OK PLEASE GET GET BACK TO ME AS SOON AS POSSIBLE. IF NOT I WILL BE MORE THEN HAPPY TO GIVE YOU A REFUND.... I AM SORRY ONCE AGAIN... AND THANK YOU...

I was like wtf at the engrish, because I emailed the guy before hand and he seemed pretty normal.

his amazon userid is 313wesellstuff and the start of his email is ajdice1985. So I assume he is 22 years old.

The item is for an xbox 360.

Could he just be getting cold feet from being his first sale on amazon? or is he trying to pull a fast one?

edit:

I replied to him (had his name from a previous email when I was asking if I could pick it up locally (it says it is shipping from MI and 313 is the area code in his user name (southeast Michigan, but he replied that he is in Kansas at the moment).

Abraham - Can you send me a screen shot where it says you need to wait 14 days? The charge should post to my CC tomorrow. Thanks.

He just replied with:

I CAN COPY AND PASTE WHAT THEY SENT ME I KNOW AMAZON.COM WILL TAKE THE MONEY OFF YOUR CC BUT I WONT GET THE PAYMENT UNTIL AFTER 14 DAYS BECAUSE I AM A NEW SELLER BUT I CAN GIVE YOU A REFUND IF YOU WANT AND AFTER THE 14 DAYS YOU CAN BUY THE IT FROM ME AFTER THAT OR I CAN SEND IT TO YOU OVERNIGHT AFTER THE 14 DAYS AND PUT IN A FREE GAME FOR YOUR XBOX 360 IF YOU WANT... IT UP TO YOU...
THANKS

to which i replied:

What is stopping you from shipping you by October 5th like the email states? It's not like you won't get the cash.

He just sent me this link:

http://www.amazon.com/gp/help/...ay.html?nodeId=1161250

Seems like he is telling the truth. Is there something I'm missing with the policy listed in the amazon link?

edit2: Thanks for the move Mods!

amazon does hold the funds for 14 days. amazon requires the seller ship within two days of you paying though. forward his email to amazon and he'll get shut down. tell him to send you the xbox now or to refund your money. let him know if he refunds your money you'll respond with appropriate feedback. negative feedback is worse for sellers on amazon than it is on ebay

Thank you for writing to us at Amazon.com.

I'm sorry to hear there's been a misunderstanding regarding your
recent order. I reviewed our records and confirmed that order #xxxxx was successfully submitted and that your payment to
the seller, Shavon Black, was processed. When a seller receives
payment, they're required to ship the order (or to refund, in those
rare cases where the item is no longer available).

You're welcome to use this information as additional confirmation
when contacting the seller through "Your Account." If the seller has
questions about how to proceed, they should contact us at:

http://www.amazon.com/gp/help/...y.html/?nodeId=3569501.

Here's how to contact the seller:

1) Click the Your Account link at the top of our site.
2) Next to "View by order," click the "Go" button.
3) Click on the appropriate order.
4) On the order summary page, click "Problem with this order?"
5) Click the "Contact Seller" button.

The estimated delivery date for this order is October 11, 2007 -
October 25, 2007, as noted in Your Account and your order
confirmation e-mail. Because it's still possible that the seller
will use their online tools to verify order status and ship the
item, we'd like to ask that you wait until the close of business on
October 30, 2007 for your order to arrive.

I'm sorry for the inconvenience of having to wait longer for
delivery, but we want to give the seller a chance to fulfill their
responsibilities and ship your order to you.

If your order does not arrive by the date mentioned above, please
let us know so we can take further action.

Please visit the following link to provide the information we
requested:

When we receive a report from you using the form above, we will
investigate the status of your order and do whatever we can to
resolve the problem.

We want everyone who visits Amazon.com Marketplace to have a safe,
enjoyable experience. Not only do participants in transactions
review one another, but Amazon.com also provides oversight and will
suspend participants who violate our terms of use. Credit card
information is held on Amazon.com's secure server, and is not shared

If a transaction with a third-party seller is unsuccessful and you
are unable to resolve the dispute with your seller, you may be
eligible for the A-to-z Guarantee. For a detailed description of the
A-to-z Guarantee, please visit:

our Shopping Cart or 1-Click ordering), by offering customers the A-

wire transfers, are not covered by this guarantee.

That said, it's wise to do some research before buying an item. Most
sellers will have feedback and ratings posted by participants in
their past transactions. You can view the overall rating and
transaction history of a seller from the detail page of any item
they have listed. If a seller has not yet received feedback, or if
you see cause for concern, you may contact the seller directly with
any questions about the item or transaction.

the good news is you paid with a CC

so you wait until the end of the month, then if he doesn't ship, you report him to amazon and dispute the charge on your CC when you get your statement

Ditch him.
His getting the money in 14 days is per Amazon. I can't see how he would be losing any money by shipping the item now. You paid so you should get the item. Holding onto it until Amazon releases his money is not doing him any good.

Why not? The seller KNOWS that the guy paid already. It is Amazon that holding it up. They are probably holding it up for the very reason of sellers not shipping.
