is this considered piracy?

I don't think it is... you own it, therefore you own the rights to download a backup. Although I'm sure it's still legally wrong due to our bullsh*t laws.

I don't think its piriting either. since you do not buy the game just the key (or so they say). so yeah you should be able to download the game etc.
 
As long as you download it, whether or not you own 15,000 copies and they're on their way to you, it's considered piracy.

by law yes it is. but ethically and morally? no i can't say it is. Since they claim that you do not own the disk anyway. just the use of it and the key.

i don't see how they can complain that you downloaded another copy when you have a legal CD key you had purchased.

but that won't stop them from nailing you if they can. i just don't think it is right or piracy.

Its not an infringement since you have a copy of the game. Even if you didnt have a copy and your friend let you use his copy, that is not infringement either.

So if I bought a music CD and then afterwards downloaded some lossless encoded MP3's of the same tracks, you would consider that pirating?

If I bought the "creative rights" with the CD purchase, wouldn't that extend to the MP3 version too?

No, it's not piracy. You're acquiring a back-up of the copy of the software. The thing is, if the game uses a CD key, you need to use yours, or then it's piracy 😛.

I mean, c'mon people... by your definition. If I took a game on my file/media server, ripped it to an ISO and downloaded it off that machine onto my main machine... you'd call that piracy :roll:. The point of cd checks and junk is to avoid people who do not own the software from playing it. The OP owns the software in question.

Doesn't matter, waggy, as long as you use your CD key. If you use his, then yes, that's not legal unless he gave the game to you.

while right. i bleeive they made the fact of bypassing copy protection against the law. wouldnt this break it?

It doesnt matter. The only time the anti-piracy bullies have any case is when you happen to be sharing your copy with 1000s of friends.

Well, he'll most likely have to use a no-cd crack with it even though he has a legal key. But this is a real gray area for software.... For example, I'm tempted to use a No-CD crack on Rainbow Six Vegas, because I don't like leaving the DVD in my optical drive. I own the software and everything, I just don't want the disc in there. Is it illegal? I think it is against the DMCA actually (circumvention of copy protection mechanisms as you mentioned), but I don't think anyone actually cares if you paid for it.

you don't receive any "rights" with a CD purchase, you bought a CD , not a license
when was the last time you got a license agreement in a CD?
