Is this a bug in Vista?

Checked "keep the toolbar on top of other windows" option and it still gets overlaped by other windows from time to time. It's a small issue but annoying. Is there a fix to this? I keep my vista fairly updated except for optional driver installation.
 
Where is your taskbar located? I put mine on the top of my monitor since it feels more ergonomic that way to me, but I have found that plenty of programs will still go under it (I guess they have the taskbar's size hard coded or something and then assume that it is on the bottom... i don't know)

If you taskbar is on the bottom.... then I am not sure where the problem is. I have never had any issues like that when I am on a system with the taskbar on the bottom.
 
I think that's more of a problem on the application side. Some applications probably do it intentionally I think. For example nVidia's driver installer. Presumably they don't want you trying to run or access other programs while you're installing their drivers. This happens in XP too.
