Evolution is moot, but not for the reason you listed. In almost all cases, the woman participates freely in the creation of said zygote. It doesn't fertilize itself.

FWIW - I am pro-abortion, but I just feel it is murder, it's one type of murder I'm okay with. I'd also be supportive of duels, as long as both parties are consenting, something that is outlawed.

I agree, it is a simple biological fact that sperm and egg cells are alive, and so are zygotes, embryos and fetuses.

It can be an error in fact according to you, we'll never know the truth though. - edit: legally speaking you're right, it isn't murder - I used the word incorrectly. I would retract my statement but in the event you saw it already I wouldn't want you to think i'm being disingenuous.

Also duels would probably stop so much violent crime it isn't even funny. It seriously was terrible legislation to ban them.
