Is speeding under 15mph breaking the law?

I've done 13 (43 on 30, thought it was 35 :( and the cop said it has to be 15 for him to give me a citation, he only gave me a warning thought. :) Otherwise, it would had been about 144 bucks in fine, and a 50 percent increase in insurance rates as well :shocked:
 

What the hell are you talking about? Speed limits are LIMITS. 1 mph over the SPEED LIMIT can get you a citation.

I've *heard* that under 10 and its like a non moving violation or some such nonsense. I dont believe it though.

He can give you a citiation even if you are under the speed limit if he feels you are going too fast for the current conditions.

You shouldn't--that's wrong. As mentioned we can ticket for 1mph over the limit, but you won't find many officers that'll do that (even though the fine here is the same between 1 & 15mph over). The "10mph Rule" is a preference that a lot of officers employ, but it's not a hard-and-fast rule...so don't count on not being cited.

1 MPH over the speed limit is breaking the law by technicality. It's up to the officer pulling you over to decide if he want's to actually enforce it.

Here in Arizona, there's two types of speeding tickets - one for anything under 30 over the limit - it's just a normal ticket. Over 30 over the limit you get into what's called a criminal speeding ticket. It's up to the cop's discretion again to decide if he wants to enforce the criminal charges or not. Criminal = huge fine, towing away of car, and possible suspension of license.

The laws vary from state to state regarding what can be done for certain infractions of the speed limit. In IL for instance, I believe they give you a 3-5 Mph leeway to compensate for the inherent inaccuracies of your speedometer.

Just my bad luck I guess, the cops just happen to be around the corner and the road soon changed to 45mph within 500 FT. If it was 35 and I'm going 43; it's within the speed limit

i got caught doing 40 in a 25, my insurance company didnt care.. they said as long as it was under 16mph over it wouldnt effect my insurance rates. of course if i got a lot of them they said it would :p I got a $170 ticket and 4 points on my license.. but my insurance stayed nice and low.

The 10mph thing, like bradruth mentioned, is just a guideline. But anything 15 and over is reported to your insurance company and will raise your rates more than likely. Under 15, and I don't know if they hear about it...not absolutely certain, though.

Bingo. Though if you contest those tickets you have a really good chance of winning.

A ticket for up to 5 over is pretty much a waste on the officer's part since speedometer error is generally between 0 and 10%. You generally have to really piss the officer off before you'll get ticketed for anything 5 over or less.

What the officer probably meant in the OP's case was that once the infraction is 15 over, the officer is _required_ to write the ticket while for instances under 15 over the limit the officer has some discretion.

It all depends on your county and state laws. Here in Texas, 10+MPH over the limit can get you a "speeding ticket". A few MPH over the limit can get you a lesser ticket such as "failure to control speed" or some other BS.
