In NY, if the police have their lights on while on the shoulder, it's illegal to pass them in the nearest lane without slowing down. (Or switch lanes) But, that's rarely a problem. Rubberneckers??? In my area?! LOLOLOLOL. The average distance between cars on the interstate (about 6 miles from my house) is roughly a quarter mile. People could come to a complete stop for a second or two, then accelerate and no one else would need to slow down. And on the state route that I'm a couple hundred yards from, traffic-jam means you have to wait til a car goes by in the oncoming lane before you pass the Amish buggy. That happens about once every 4 months to me.
