Is it punishable to sell @ above retail price?

There's a very obscure law that states if a business is caught selling above a manufacturer's MSRP you can force the business owner or one of it's employees to sodomize a chicken.

Yes it's punishable. It's punishable by now one buying your merchandise.
Of course, if we are talking about Ebay, there is always some dipwad willing to overpay just so he can feel he is a "winner."
So the punishment is having a sucker pay you too much for your overpriced item.

it's called "dealer markup" like on hot new cars that come out.

Dealer markup is the has been term. Marketing has since rebadged it under the more trendy slogan of "market adjustment".

I would think you could set your price to whatever amount you'd like. However, you probably won't have much luck selling whatever you want to sell if someone has that same product cheaper.

I think that only applies in West Virginia. In Kentucky, you have to toss the chicken's salad afterwards.
