Is it legal for others to dig through your trash?

Last couple of weeks someone's been digging through the trash on Trash day and making a mess. I take my cans out the night before the trash gets picked up and someone comes early in the morning like 4AM or 5AM and digs through it throws stuff around the grass and leaves. I have no problem with it if they just take stuff and don't make a mess because I have to pick up after them and its annoying.

you sure it isn't raccoons or opossums?

I believe it is still your property until the city/trashmen take it from you; so trash diving is actually illegal.

You should watch the burbs.

They start going though the garbage in the truck and someone protests to which the garbage man spouts off some civil regulation stating that trash is public property once it is put at the curb.

While i dont believe everything the TV says, i would assume that the law does in fact say its public property. Otherwise you could through your broken DVD player out, and then sue the city for crushing it in the truck.

Then again, it was a movie.

Yea, theyll actually rip everything apart to look for even morsels of food. Make sure you shred all your papers that are important incase it is a person looking trough it.

It may depend on where you live but I don't think it's illegal at all. I believe once its set out, it's public domain.

I think the rusty razor blades idea is a good lesson.

I would think that the littering part of it may also be illegal.

If the trash is close to the curb, chances are it is on a city owned right of way.

putting razorblades in them is ascenine. If its an animals you could kill them, if its a person you could injure them very badly. And if its an ATOT poster who happens to read this, you'll be sued for everything you have and maybe wind up in jail. :p

Its probably an animal. racoons are famous for making a mess and leaving it to look the the homeless raided yout trash.

It's public property, but if it's a fairly routine thing, call the cops so they can witness what's happening. They'll at least get cited for littering.
