Let say I take a picture of someone with my camera phone without her knowing. Is that illegal? No something compromising like an underskirt pic or of her cleverage or something like that. Say someone who you see and think is hot and you want to take a pic of.

I think it depends on where the picture was taken and if you're going to make money off of it.

If they're in public then it generally okay because there's no expectation of privacy.

I'm sure this varies by state.

as long as they are in public and you don't break any local laws to gain access to the person you are photographing it is legal to snap pics of anyone you want. just remember depending on your local taking a pic of someone on private property may or may not be an invasion of privacy, but for the most part as long as you are shooting from public property and they are clearly visible then they are fair game. but you still might want to check your local laws.

Of course it isn't illegal... whether the person is on private or public areas. If they were, how would the paparazzi make money? And they even use those photos commercially.

What law is behind this? I've heard of this before, but nobody has ever been able to establish any proof for this. The reason why most security cameras don't have sound, is because they're situated in areas where there would be no sound to pick up anyways. But some cameras DO come with sound. 4/5 of our security cameras have the ability to record sound (although only 1 does).

Celebrities are different than regular citizens in this situation.

A good rule of thumb is that if your subject has no "reasonable expectation of privacy" it's OK to photograph them.

If you see them in the mall and you want to take a picture, then that is fine.

If you see them through a window in their home and you want to take a picture, then that is stalking.

I've been reading a lot of news about gyms banning camera phones and what not. My gf usually says "go sit at the corner if you feel tire and bored" when we go to stores like Forever 21. well.....I am usually bored so I sometimes start taking random pics :p.

No man.

If your in public you are game to any pictures taken. You are out in public you have given up your right to privacy by being in public. Thats why you don't hit on paparazzi as then you get in trouble. Yes lame what they are doing but they can do it.

Out in public gives the right for people to take pictures of you, videotape you, record your voice, whatever they want to.

If you're in a public place, you have no privacy.

A celebrity has less of a right to privacy than others who aren't celebrities do.
