Is it illegal to sleep in your car if you are too drunk to drive?

I have an 89 Ford Aerostar Minivan with no seats in the back, I took them out because I am always haulling band gear in the back (amps, drum sets, etc....). I do have a lounge chair in the back where I like to chill out in like during my lunch break at work, at the park, etc....

Anyways, When I get too drunk at the bar, if one of my friends is not avaliable to drive me home I will usually just go ahead and sleep in the chair in the back of my van. However, one of my friends told me recently that this is illegal. If it is, why is it? Would they rather me drive drunk?

depends on the state. in some, if the keys are in the ignition, they'll DUI you
others, if you are even in the car in the driver seat, yes, they will DUI you

if you are in the back of a van, i dunno, some hard core cop might haul you in, who knows

just stay home if you are doing the drinky drinky

Make sure someone else has the keys or toss them into a field.


Remember to be careful, you might still blow over the limit in the morning.

It is IF you have reasonable access to the keys or if the keys are in the ignition.

It is not illegal. It is illegal to be "APC" (actual physcial control). A cop once told me to place the keys in front of one of the tires. Roll on top of them and stop. Now when the cops come they can't find the keys and you are not in APC.

This was discussed earlier. Its a fvcking bullsh|t law because it promotes drunk driving. You're less likely to get snagged by a cop driving then sleeping in a bar parking lot all night, just by virtue of being out for a longer period of time.

Exactly what I was thinking.

Someone needs to invent a cheap timed safe, just stick in there and lock them up.

maybe you can just swallow your keys, then by the time you poop them out the next day, you won't be drunk anymore

What I would do is put a "Club" on the wheel. Not only does this prevent someone jacking your car, or stealing it because you are too drunk to stop them, but makes it so that there is no physical way to drive the car with the car keys alone.

You'll get a ticket for DUI if you forget to take the key outta the ignition key hole, unless you drive a luxury car w/o ignition key hole, then you're cool.

They make it! Its called a hide a key box. Stick you key in the box and put it under the fender or car sticking it to something metal :p

How are you supposed to do all that while drunk? They really expect someone to push their car over their keys?

Put a lock on your glove compartment that the ignition key can't unlock. Then lock your ignition key in the glove compartment when drunk. The key you have to use to unlock the glove compartment can't start the car.

1. Roll forward.
2. Lay the keys flat before rolling over them. That may involve removing the cars keys from the ring.
