If it isn't..shouldn't it be like manslaughter or something? I mean, having HIV doesn't mean you're going to die or anything, especially nowadays, but still, you're basically infecting someone with something that can potentially kill you.

I would guess that it would be like reckless endangerment or something, unless, as has happened, it was with intent to transmit the disease or the person partnered with many many people.

[edit] Not merely the act of intercourse, I mean having intercourse without fully informing the partner

I am assuming you drive or have at one time in your life been in the seat of a moving car...
Everytime you get in a car, you are entrusting your life to the other drivers. Its the most impersonal relationship, yet I trust them with my life. I trust they wont do anything stupid, and get me killed. I trust they won't drive drunk and slame into me when I cross an intersection. I trust that on the freeway, the guy next to me wont decide to quickly change lanes. The mere act of driving next to someone can potentially kill you.

Just thought I would share.

You guys ever watch the news? It seems like every 6 months someone makes national headlines for having sex with others without telling them they have AIDS or HIV.

Last one I remember was like a 16 or 17 year old girl who had HIV and turned slutty. She then had sex with like 18 guys and was arrested. They said on CNN that the girl was actually laughing when she was being interrogated.

It's a crime that deserves the death penalty imo. Rather than killing someone right away, you're making them suffer a slower, more expensive death. :disgust:

How do you think HIV/AIDS spreads?
How many times have you seen an "HIV Spreader" being persecuted on TV?

Wouldn't that defeat the purpose? Why give the death penalty to someone who is already going to suffer?

INTENTIONAL TRANSMISSION OF HUMAN IMMUNODEFICIENCY VIRUS

201.205 Penalty; affirmative defense.

1. A person who, after testing positive in a test approved by the state board of health for exposure to the human immunodeficiency virus and receiving actual notice of that fact, intentionally, knowingly or willfully engages in conduct in a manner that is intended or likely to transmit the disease to another person is guilty of a category B felony and shall be punished by imprisonment in the state prison for a minimum term of not less than 2 years and a maximum term of not more than 10 years, or by a fine of not more than $10,000, or by both fine and imprisonment.

2. It is an affirmative defense to an offense charged pursuant to subsection 1 that the person who was subject to exposure to the human immunodeficiency virus as a result of the prohibited conduct: (a) Knew the defendant was infected with the human immunodeficiency virus; (b) Knew the conduct could result in exposure to the human immunodeficiency virus; and (c) Consented to engage in the conduct with that knowledge.

Yep. It depends upon the location, but there has been prosecutions at the state and local level for having sex with someone after you KNOW you are infected.

persecuted or PROSECUTED.

i'm pretty sure you meant to say PROSECUTED.

but i would persecute anyone who intentionally gave others aids.

Right now as I type a man is on trial for deliberatly spreading aids in my city of London Ontario.

This is our second trial for this offense. The first was about 10 years ago. Charles Ssenyonga died just before the jury came back with the verdict.

in Ohio, it's a very very very seriously taken crime if an HIV infected person has sex with someone without informing them of such...
