Is "I don't remember" the new Fifth Amendment?

Interesting how the two troubled Bushies both are claiming "I don't remember" defenses.
Instead of using the publicly suspect Fifth Amendment defense in not answering questions they use the more palatable I don't remember.
It will be interesting to see in the future if the public, or juries, will accept I don't remember on a regular basis.

If they use the 5th, Congress can use it against them in limited (shart yourself) immunity.

And they know that Congress will do so.

Its not a new strategy for people on trial by any means. It actually can be an effective way for an unwilling witness to avoid giving testimony if the claim is remotely plausible. (You have to prove beyond a reasonable doubt they absolutely remember before you could go after someone for perjury for such testimony.)

Whether the public will buy the excuse is another matter.

Are you implying that techs approved of it was it was a democrat doing the same? He never said such. Please show us where techs implied or said that democrats should be allowed to do it. Otherwise you are just saying "they do it too so it is ok".

That's not necessary, just put Rove on a treadmill with a can of vienna sausages dangling from a stick in front him, I guarantee he will cave in ~15 minutes.
 
The proper response is 'I don't recall.'

Ronald Regan used it quite well during Iran Contra. Sad thing is he really didn't recall due to alzheimers.
