Is drug testing a violation of privacy?

they could fire you if marajuana suddenly turned up legal and they didn't want their employees using it. employment is at will.

I've had a false positive on a drug test before. When it came back they asked me about it ofcourse and I was stunned and then they started asking me if I had anything to eat/medication recently. Well.. I love Poppy seed bagels.. Sooooooo we figured that was it and i had to take a retest.

They could still fire you. How could they know for sure where you were when it happened? If they accepted that excuse, everyone would just claim that they were here or there and it was fine. Companies don't want to take the time and spend the money to investigate it all so they have a zero tolorance policy. It's kind of like if you are in a state that has a BAC limit of .1 and your BAC is EXACTLY .1, then you drive to a state with a BAC limit of .08 and get pulled over...you will get ticketed and stuff.
