A Chinese company, who made an iPhone 5 clone based on leaks and rumors is planning to sue Apple over the iPhone 5 if it looks anything like their fake iPhone 5.

I think this might be taking patent trolling to the next level. They've got balls, that's for sure. And lets give them some brownie points for audacity.

I've been posting less in these forums because of posts like yours.

I posted this article to bring some levity and humor. I do not want this turning into an Android vs iOS thread.

lol, this would be hilarious.

they wouldn't have a case though, as the leaks themselves are proof apple was working on an identical design before/at the same time.

Although humorous, the case wouldn't stand up in court. Apple would have submitted applications for design patents for their new device long before it entered production and parts or images began to leak. Because is most jurisdictions, design patents can be kept secret up to a certain period of time, Apple would have been able to submit the applications without the results being made public (unlike FCC approval which is made public).

And of course we're talking about Chinese court here. I have no idea what would stand up in their court system.

This is pretty funny. The iPhone 5 copy is a copy itself!

China is also notorious for kirfs and doesn't care about any kind of copy infringement, which makes this even more ridiculous.

It's pretty impressive to get the KIRF out before the original though! I can see why everyone gets stuff made there.

An obvious publicity stunt.

Still, since Apple is shamelessly exploiting a broken system to stifle competition it'd be some form of much-deserved comeuppance for someone else to exploit an even more broken system to harass them. Karma being a bitch and all...

Apple copied Android with pull-down notifications, so they copied EVERYONE else's smartphone.

As soon as Google gets the patent for those, they'd be perfectly justified in banning every Apple device with those, playing the same game as Apple. You'll of course yell and stomp your feet, never admitting that Apple has sued to block others based on far less.
