Internet Legal Advice Needing

I run a group of game servers all titled "House of 1000 Corpses." We don't have a UT2004 (a specific game) server yet so we were about to launch one. While doing a search, I found out that someone has a server titled {HTC}.

I researched this and found out this was a clan called "House of 1000 Corpse" (no s at the end). I quickly registered www.houseof1000corpses.com and redirected it to my clan's site so that people looking for our servers could find the right site.

I then contacted the other clan out of courtesy to let them know that we would be launching a game server entitled "House of 1000 Corpses [Tucson] [BadAZ]" within the next 12 months. This name is somwhat similar to theirs and I wanted to make sure that the 15 members of their organization didn't get confused.

I was responded to by their leader posting my email on their main landing page and asking his members to send me email and let me know I was stealing all of their hard work. They were under the impression I'm trying to steal their userbase (all 15 member...sigh).

I have informed this group that I have been running these servers for quite some time (before they had their site according to their history and what they have told me).

They are now threatening to sue me based on this: http://www.techlawjournal.com/cong106/cybersquat/s1255is.htm and have notified me of the following:

"Just bringing this to your attention aready contacted an lawyer
verified i do have a case so if you wish to continue useing the houseof1000corpses.net domain directing it to your web site badaz.net
i will persue all actions nessesary to retain such domain from you at your cost
this is and will be your only warning "

I'm pretty sure this guy is full of *#&$ as far as having a case as we are not stealing anything from him and have a completely separate name of our work.

I had a few questions:

1) Could this guy actually sue me over this?
2) Does he have a leg to stand on?

Wouldn't they need a copyright, or trademark to the name of have any legal grounds? (I'm just throwing throughts into the air, I don't know anything about this kind of stuff)

He is not going to waste his time and money over something he really has no rights on.

but yes he can sue you. will he win? nope.
 
Ignore them.

It's hard to gauge their response without knowing the exact wording of your heads-up but it sounds a little unreasonable.

Note that any further contact you have could come back to bite you in the really unlikely event that legal action happens. (And anything you post in this thread could haunt you as well.)

Rule number one of legal action: shut up.

1) Yes. If he has the money to give a lawyer he can sue you over just about anything.
2) Highly unlikely.
 
Unless they have a copyright on the name you are clear. Only thing I would be concerned about is Rob Zombie's stuff already mentioned. Better yet, find the kid's phone number through whois or similar and call him then listen to him ****** his pants.

I'm aware of that as well and would easily change names if that were the case. BTW, I've worked for him before and could probably get written permission to use it.

Forget them.

They are only protected if they have a protectable trademark on the name, which i can fairly assure, they don't.

 
lol, send him a nice reply from Mr. Zombie requesting a cease and decist on their clan's usage of the name 😀
