Intel SSD 750 pci 400GB, diagnosis lights on side do not work. Is it DOA?

I purchased this drive to use with a SuperMicro motherboard part # MBD-X10DRH-ILN4 with two Xeon e5 2695 v3 running Windows 2012.

I tried the SSD in three different PCI slots on the motherboard and worked with the Supermicro tech support.

In all three slots, the SSD never had the diagnosis lights on the side light up. I then tried the SSD with an ASUS Rampage Extreme IV board and an ASRock Fatal1ty Gaming Z170 ITX. On both of the other boards, the diagnosis lights did not work.

So did I get a bum SSD from Intel?
 
Windows Server 2012 is similar to Win 8. Have you installed the diagnostic software that drives those LEDs?
 
I think mine lit up before I installed any related software (unluess the diag. S/W is in the driver). 3.3.5 is the latest Intel SSD ToolBox.

I haven't installed any software. The "manual" that came with the drive implied that the lights would work during boot.

According to Super Micro, after I change the PCI slot from legacy to EFI in the BIOS, the drive should be visible as a bootable option in the BIOS.

FWIW, the SuperMicro motherboard works wonderfully with Windows 7 installed on an Intel 535 drive. This was mainly to check that the CPUs and memory were in good shape while I waited for 2012. Sadly the 535 drive is going into a raid array😱
