Insurance/Legal advice/listening to me scream needed

UPDATE I've contacted the MPs at Ft Myer, and they're looking into locating the guy. Apparantly at least his name is correct, so I'm going to at least get in contact with his CO. The cops DID NOT get his unit information, I suspect that this kid may actually be an MP which would explain why the cops were so lenient with the bastard. The body shop has begun the $6800+ of repairs, and right now I'm slated for the $500 deductible. Which isn't the end of the world.

Anyone know what's likely to happen with my premiums?


The car... 2003 Nissan Altima 2.5S 5 Speed....

The accident...

I'm stopped at a red light... this is an overpass.... to my right and to my left, are ramps, leading onto and from the freeway below, each of which have traffic lights before letting the cars onto the road I am on stopped at my red light. Light turns green, I out of paranoia, look right and left ensuring all cars have stopped at their respective red lights before moving much through the green light. I proceed through the intersection, when I hear a load bang, and honking, and from the right, a Jeep Wrangler, sideswipes a car stopped at the red light to my right, and comes flying towards me... there's nothing I can do except look at my GF sitting in the passenger seat, as the Jeep T-bones me on the passenger side. The blow spins my car 90 degrees, and the guy pushes our car a good 10 feet or so, before putting the jeep in reverse and attempting to pull back. His bumper is imbeded in my passenger side, so he isn't going anywhere without my car.

The guy then leaps out of the car, and takes off running down the street. By the time I've gotten out of my car, and verified that my girlfriend is intact, the billion witnesses are gathered around comiserating with us, and the people in the sideswiped car. Cops show up shortly thereafter, and take off in the direction the guy ran off in. A few minutes later they have the guy handcuffed and sitting on the curb. They do all their paperwork... give me a form with all his info on it, and they give me this explanation.

Well he's a kid in the army, we gave him a blah blah test and it came back clean, so we're probably just going to charge him with Reckless driving.

me: Ummm what about fleeing the scene of an accident.

cop: well this kid is in the army, and he came back.

me uhhhh what? Well what do I tell my insurance company?

cop: just tell them that he was charged, and you were not, the accident report number is blah blah blah.

I'm just so ready to go home at this point that I let it be, get my crap together and proceed to walk to my GF car which fortunately was only 3 or so blocks down the road. *THE COPS WOULD NOT GIVE US A RIDE*

So I call the insurance company that night, and file my claim, and call his insurance company and file a claim there. The next day his insurance company calls back, and says 1) He's not insured by them, 2) all of the information he gave phone numbers, etc. Are false.

Now my insurance company calls with the same info.... they proceed to file the claim under collision. Which means I am stuck with my deductible. They say they can't file it under uninsured motorist, until they verify that he doesnt have insurance. They of course can't do that until they have correspondence from him.... which they aren't gonna get.

What the hell do I do now?... My premium is likely gonna go up? I'm gonna get stuck paying a deductible as if the accident was my fault? Can I sue this m-fer?.... What the heck do I do...

Said person is in the Army, driving a 2004 Jeep Wrangler, accident occured in VA, individuals car is registered with VA tags, and he has a NY license.

can you possibly find out what battalion/unit he's with, I'd think/hope/pray the cops would be competent enough to have some more information as far as some type of military ID that they saw and recorded. going to his CO would certainly give him a wake-up call.

possibly get contact info with driver license info?

btw, are you in an army town? sounds like the cops were not doing their job.

nm, saw you are in Arlington, cops were cutting slacks for army guy, eh?

I'm guessing going back to the cops has yielded you nothing. I wonder if contacting the Army would lead you anywhere.....

Did you try calling the cops and telling him that he gave you false insurance information? They may be able to give you some more info, or at the very least, try and get it from the guy himself (provided he didn't give THEM false information). If the police took down a registration number (would that be on the accident report?), you should be able to get some info from the DMV about where the vehicle is registered to. Pass that information onto the insurance company.

Hope this works out for you, sucks that some idiot thought carrying around fake insurance info was a good idea.

So do you have his real name or what? You got the license number and stuff, right? Iono about where you are, but in california, they'll just look up whoever owns the car and submit some form, I think its s1 or something or other, I don't really remember to the DMV. DMV replies with so and so doesn't have insurance. Then they submit like an S11 and the dmv sends back confirming such and such doesn't have insurance and bam, you get to file it under uninsured motorist.

I just woke up, don't expect me to remember the forms correctly.

That sucks man. In times like that, hope for the best, but expect the worst. Be an optimist and be happy that you're gf is ok and you had insurance. It's just a car and a deductible. Things could have been a lot worse.

I was just going to talk crap but decided against it. I'm sure it happend fast but next time hit the gas when you see a car coming towards you. It's likely your premium will go up however there has to be some information about the owner linked to his Jeep, especially if it was that new. I wouldn't stop trying to find out who he is. However you probably won't get any money from him by suing or anything as he won't really have much seeing as he's in the military.

Dude you should file something against the officer that took the report too.
From the info you have provided the officer of the scene seems like a huge anus.
What kinda tard officer can't even get the person information correct ?

If he manages to get in contact with the guy's CO, then he has a very good chance of recovering damages from him. The military doesn't take events like this lightly, and you can bet he's going to get in a LOT of trouble when his CO finds out that he lied to the police and fled from an accident. I wouldn't be suprised if they garnished his wages to cover the damages.

Keep us updated.

Edit: Also, if you can't find out who the guy is, consider suing the police department for negligence. They definately fvcked up big time, and now its costing you money. Even if you do recover damages from the kid that hit you, I would still file a complaint.

You're joking right? I did that.... I floored it and popped the clutch... there wasn't anything I could do. He was totally out of control, and came from behind a bunch of cars who had stopped at the red light... not even a Jedi could have avoided that accident.

if this guy had floored it, likely the cops could have pinned the fault on him.... since he was moving as well.

There is only one option: JUDGE JUDY! Haha sorry I couldnt' resist. Anyways, you should check to see if the car was registered in his name and whatnot. Good luck, sorry this had to happen. As for the guy who said hit the gas thats probably the last thing you want to do in a moment of panic.

Call the cops again and see if there's anything else they can add to their report about the false information and the lapsed insurance. (Maybe they'll charge him, but at this point, it's not for you to worry about anymore.)

You can sue the army punk in conciliation court for your deductible. (This is where you can "get" him, if you're so inclined. The only thing you have to lose is your filing fee. At best, you get your deductible and filing fee straight from the kid through a judgement.)

If the insurance co's investigation determines that you were not at fault (which it should), your premiums should not be affected.
