In todays news, we need to ban dodgeball in school

That's a tough one. It appears that the kid that got waked wasn't playing the game, and he ended up with a concussion. That's some pretty serious dodge ball they're playing. The fellow that tossed the ball did get a one day suspension at the time, so maybe there is something to it?

Assault? Unless there is more to the story that sounds stupid (was it a purposeful wicked hard toss at a non-player's head, as an example? Or just a playground innocent accident?) Not sure it is racism that is causing this kid to be charged, this happened in Detroit, this could very well be plain old stupidity.

Nothing in the story indicated kid with ball was trying to injure other kid. That kind of shit happened on a regular basis in elementary schools before they got soft.

We used to play it under a different name way back in the dark ages (smear the fellow that prefers men), I never saw anyone get badly injured.

And the fellow that tossed the ball got a day off for it, says so in the story.
 
Really not enough details to make a judgement call on any piece of the puzzle. Victim's mom said there's other incidents, presecutors think there's enough evidence to move ahead, I'll wait to see how it goes. Could be just the result of bullying.

I'll agree with others, dodgeball was no joke, very competitive.
 
Did anyone actually watch the news cast? Goes a little deeper than the print copy regarding this event that happened back in April. Though this stuck me from the copy:

The case, Wayne County’s assistant prosecuting attorney Maria Miller tells Yahoo Lifestyle, “was evaluated by our Juvenile Prosecuting Unit, and it was determined that there was enough evidence to for us to charge aggravated assault.”

I am going to go out on a limb and say there is a low probability that this was some innocent, isolated incident if Wayne County to bring these charges. Racism? Doubtful and hard to prove but the assault? Doesn't sound like the kid was playing any sort of dodgeball game with this other child and that there was a history of this happening, it being addressed, and reoccuring...

I thought today's news was that the president just endured scathing testimony that recounted mountains of evidence for his 6+ felonies, including multiple attempts to obstruct justice.

Yeah, going to have to come up with some more details to sustain ag assault on a kid with something sports related. Like deliberately nailing the kid in the head while he was defenseless kinda thing, while saying "hey watch me get this punk." I'm other words specific intent to injure or clear disregard for risk of injury.

for what it's worth, a local news story with a bit more detail. It's claimed that it was intentional and caused some hurt. The mother of the hurt kid claims this was the third time her kid had been hurt in the same manner while playing the game (apparently not by the same kid though). Makes me think the injured kid might be dealing with some bullying problems at his school. Hard to tell from what little info is available.

If this is the 3rd time it makes my wonder why *this* kid is being charged alone. Why not the 1st or 2nd kids?

EDIT: I'm assuming that 2 previous incidents means 2 kids but it could have been 1

Based on the articles I've read it seems like he was playing (all 3 times) and I've seen nothing in any of the stories that I've looked at so far that indicate any prior issues between these two kids.

There really are more questions that answers at this point. <shrug>

I do have to question police involvement in this though.

I guess I read it wrong initially when the mother of the boy charged said he was playing with his friends (thinking that meant a distinct group from the injured boy), but if you pause the video at the right points, you can read the police report well enough to get a decent picture of what happened.

It looks like the kid that got hit, tossed it up in the air towards the kid that was charged, and that kid didn't/couldn't catch it. That was supposed to end the game. Then the kid that is charged, deliberately threw the ball at the injured kids face (when he wouldn't be expecting it), and made a statement with it that it was intentional (something like that's what he gets).

Their is also snip from a medical report that lists more medical info that was redacted from the police report. The kid has a congenital brain issue, which may have made the concussion more likely. But, a black eye from a direct face shot is likely not, and more likely an indication of how hard the ball was thrown directly into the kids face.

If he were an adult, I'd be ok with charging him for directly spiking the ball (deliberate action not any accepted part of the game) into someone's face hard enough to do that. I'm just not sure a 10 year old is responsible enough yet for that, unless there's prior history of similar deliberate conduct that hasn't responded to lesser intervention.
 
I could only see assault charges being appropriate if there is a history of this boy physically harassing or assaulting the other.

If not, then unless some evidence exists that he intentionally threw the ball at him with the intent to injure I don't see the justification for assault charges.

Next up, Giants defensive lineman charged with attempted murder for sacking Tom Brady.

The mother of the child that got hit may have gone to police and asked to press charges. IANAL but some states allow for a "private criminal complaint" to be filed which semi-obligates the DA to at least investigate the alleged crime, unsure if Michigan is one of those states.

Wonder what kind of ball used? No way those red rubber playground balls can seriously injure someone, less a black eye.

If volleyball used and the kid had big hands then it's possible. If true teacher fault for allowing the use. I remember back in my days of middle school we played team handball. There was one kid who could rifle the ball because of his bag hands allowing a good grip. I had to cup the ball and couldn't get much on it.

My thoughts as well. Maybe if caught by surprise and it knocked them back (fell over) and hit their head on concrete?

To be honest I can't think of any ball that can give you a concussion on the face of it....
