importing cigarettes to avoid tariff?

I have a friend in spain and cigs are crazy cheap there...like a 1.50 or so a pack if not less! I was wondering if he could mail me a gift carton...I know I'm avoiding the tax, but is it ok if it is a gift? and is there anyway for customs to know?
furthermore, I love galouises, but i can't seem to get them in syracuse...

yesmoke is cool, but it looks "too good to be true"...but then again, I miss europe prices!!! and they don't have galouises! my snobby french cigs but its still good cuz they have the blue box camel lights
