images/photographs copyright questions

can someone explain the copyright issues involving photographs? with the site in my sig, i was going to put together a site with sports photos of the detroit pistons. most of the pics would be from other news sites and sports pages. would putting a disclaimer like "all photos and images are property of their respective owners" be enough? do i need to contact the photographer for every picture taken and ask for permission?

also, what about compliations/collages/wallpapers that people put together? do they fall under the same issues?

You can't use any pictures, photos or copyrighted material without the owner's expressed consent.
People use pics from my website all the time for books, websites, magazines, newspapers, etc. They usually ask me if it's okay.
When I give them permission I ask for a link and credit in exchange for the use.

Strictly speaking, you cannot use other people's photographs without permission. But in reality, you can probably get away with it if you're not profiting in any way.

...because no one really cares as long as you're not making a profit.
If you are going to make money, they want a piece.
Make sure you credit/link and odds are you won't get any flak.

yeah, i was thinking about putting the name of the photographer and site where i got them from, to hopefully avoid any problems.

now what if some random guy took some pics off the internet and made a wallpaper. do i need to find the creator of the wallpaper? does he/she have any copyright ownership or anything like that?

You need to contact the owner of the photograph. That could be the photographer, the news organization or wire service. Getty Images provides a lot of today's NBA photos and they are pretty anal about copyright issues, on any site.
