I'm guilty because a police officer says I am? Help?

A cop stops my car while it's moving and objects to me speaking until after he gives me a citation ($280 fine!). I asked him why he pulled me over, he replies "da park's closed." I say: "I'm sorry officer I didn't know that since there were no signs notifying me this area was a park or that during this time (3:00 am) this area was off limits. I took a turn into this area hoping it would help me exit, but it didn't." He then replies: "there are signs everywhere" and he concludes by saying "you do not appreciate police officers, so tell it to a judge and drive home safely." I appealed in court (i didn't testify though), and I made him admit there is no sign saying that area is off limits, he stopped my car while it was moving & not parked, and that I was not speeding at all. The rules of the road state "proceed as long as your obeying the speed limit." The judge found me guilty of being in a park area past curefew where there is no sign notifying persons the area is off limits. By their logic I lack the telepathic ability to read a sign THAT DOES NOT EXIST. A lawyer in the back of the court room listening to my trial said out loud "thats bull$h!t, there is no sign there!" when the judge gave her guilty decision.

The worst part is this: In order for me to appeal this decision to a higher court, I'm required to pay a $1200 Transcription fee to a company ONLY the dallas court system recognizes and authorizes to transcribe audio tapes of court hearings. This seems like a GREAT way to legitimize stealing money from citizens. If anyone knows of anyway they can help me, I'd appreciate it soon. Today is the last day for me to pay this fine 🙁.
 
sounds like a bogus charge

but your lawyer in the back of the court room was a lie. a random shmuck, maybe.
 
no he wasn't a schmuck he was an attorney waiting for my trial to be over since he was "defending" someone else for a similar situation. He didn't exactly yell that statement either, but everyone heard it.
 
Ouch that sucks man. Just suck it up and pay the fine. Blame it on bad luck.

at least this entitles you to loath police just a little more.
 
You have every right to appeal the case but appeals aren't based on further argument; they're based on procedural errors in the finding of judgement. That's why you have to pay a transcription fee: so that the appeals court can review courtroom procedures. So unless you think the judge messed up the case procedurally, I wouldn't recommend you do so.
 
i don't loathe police, this is the problem. This guy had a preconceived notion about me already. He admited in court that, that night he knew there was no sign in that area and to this day he knows there is no sign there. The judge found me guilty of the park curfew when there is NO SIGN telling ANY citizen that area is off limits. If I had to do it over again, I would have chose trial by jury instead of trial by judge...argh, I'm angry because it's just not fair to me :disgust:

and this helps your particular case how? The judge already made her ruling. If you're a man of morals and principle that has extra money and time to fight this I'd say more power to you man! This seems to be a very unfair situation.

But I notice you also have a Ti4200 like me, so this probably means you don't have the money to burn on legal fees to fight this 😛.

Who know maybe you could find a civil attorney that would take the case on contingency, but in the end you should ask yourself "Is $280 really worth all this crap?"
 
That does suck.

BUT every park i have ever seen (unless camping is permited) closes at sundown. But the cop was a a-hole. he should have given you directions and sent you on your way. But technicly you were in the wrong.

I fail to see why you pulled into a park to help you "get out of an area"

yeah i was thinking the same thing.
 
it doesn't look like a park! on one side it's residential area and then there's a road that curves and initially looks like it's crossing across the area to an exit. It was actually a dead-end turn around, but you cannot see it once you enter. Also there are no signs saying it's park territory from that entrance. In short, it doesn't look like your typical park in that area...just a winding road.
 
That sux.

Move to Australia. Parks here never close, and the only cops working at night are busting asians and wogs (no, Im not racist) who are street racing their skylines and WRX's.

If your avatar represents you, you can always file a civil rights suit against the court and cop for stopping you for DWB.

And yes, it sounds like a bogus charge. If you can prove that there are no signs, I would definitely appeal and file a claim for harassment as well to cover your costs.
 
I thibnk its pretty much commom knowledge ( 'cept for you) that city parks close at dusk. Too bad you cant plead ignorance.
 
You should get that cop's badge and cruiser number....follow him around and stalk his family and make citizens arrests on them for all kinds of things that don't exist. That will teach him a lesson.

 
Sounds like the most cost effective solution to this problem is to slash the judges tires. I agree with the lawyer, that is bullsh|t.
