Cliff Notes:

Got Cellphone service in April. Out the door with phone - no problem.

Got April Bill Paid it.

Around 1st of May added 2nd line - out the door with no problems.

Paid May bill but noticed they over charged me 200$.

Called provider - they said it was a deposit.

They agree with me that the definition of deposit should be something that is in my contract.

They also agree that I should have had to pay any deposit before leaving the store.

They are very agreeable.

They still want their 200$.

They tell me to call the sales company (phone sold through 3rd party establishment).

Third party establishment have been promising to help (but they don't have a clue and have not done anything).

Got mad dealing with third party establishment call cell phone co back they said they'd call the 3rd party establishment today for me.

This is after I spoke to 3 different Customer service reps that tried to tell me a fortune 500 company had NO SUPERVISORS.

4th rep transferred me to the non-existant supervisor (these calls were within a 15 minute period).

Supervisor 'will call me back' (yea right).

My position:
I signed no contract establishing a deposit was to be owed.
Any checking they needed to do should have been done as it has always been done for me up front.
I am not going to pay it.
If they disconnect me, I want the 2 different 'hookup' fees refunded to me - (I'll pay the bill).

Questions:
Who if anyone should I go to to complain next? BBB, AG office? Anyone?
Do I have to pay for something not in the contract?

Companies intentionally omitted.

I'm more surprised at the fact you guys still have to pay connection fees. Guess you don't have much competition in the mobile phone market over there!!

Refuse to pay it. Tell them you'll sell the phones on ebay to recoup your loss if they fvck with you.

heh don't think I'd get much, i got the cheapies that were on special.

I dunno man. In court I don't think that they would have much of a case. You entered a contract and were never informed of a $200 deposit.

The problem is that you're not in court. I don't know how cordial you are on the phone but it might just be time to tell them flat out that you are not paying a deposit. Make sure they know with 100% clarity that they will not be receiving $200 from you for a deposit. Tell them that trying to force you to pay $200 after the fact is a breach of your current contract. Blah blah. Don't get off the phone with them until you get some sort of resolution. It costs them money to keep you on the phone tying up a CSR. 😉

I tried that - I'm having the 'classic' noone will take ownership of this problem. I've tried staying on the phone and have been hung up on, arbitrarily placed on hold, etc.

I have told each and every one in no uncertain terms I would not be paying it.

I'm going to see if I get that elusive call back - and start trying again around 10 oclock or so.
