I'm getting evicted! Yay! (a rant)

So... my apartment of almost 3 years is soon to be someone else's.

A little history...

The first few months I lived here, the complex had issues with the girls in the office. They would keep some checks of people they liked and not turn them in, but put them down as being paid in the books. Unbeknownst to me, I was apparently one of these people. I would harass them on a daily basis "Why hasn't my check been cashed?" To which they would reply "Oh, don't worry about it, everything is fine."

I was particularly concerned because this was my first place completely on my own. Anyway, they were finally found out and my checks were all deposited to my great relief.

Since then, the apartments have changed hands 2 times. The current management company has thus far failed to change the furnace filters on a regular basis, and missed several appointments to fix things around the apartment complex. Aside from the filters, I personally haven't had a major gripe about them.

Until today. I put my check and deposit slip in the same drop box as I always do a week early, on the 27th. Flash forward to Sunday, I'm balancing my checkbook against what the bank says. According to the bank, the management co. had not yet deposited the check. So I boogie on over to the clubhouse and talk to the girl. I tell her I'm worried that my check had not cleared and I jokingly said "I'm just worried I'm going to get evicted."

Bad thing to say.

Today, as I get home from work, I find an envelope stuck in my door saying I have 3 days to either pay the rent or leave. Well this is just f'd up, so I storm over to the clubhouse, again. Unfortunately, it's closed, so I can't take my initial fury out on them.

Yeah, I've got until Wednesday to pay it, but the point is I shouldn't have to. They lost it. They have my home phone number, why didn't they call me asking about it instead of threatening me with legal action first?

I'm still a little freaked out about it, but we'll see what the days ahead bring up.

not only you have problems with the management, ur credit record can also get SEVERLY tarnished..

not to mention if you move (and rent again), the new management usually will check with the old place that you rented...
 
Just pay them with a new check and put a stop payment on the one 'they lost'.

Be sure to let them know you put a stop payment on the lost check and give them that check's number.

Edited to add: Just in case your check WAS truly lost, TO THEM it's as if you're late on your rent. Why should they have to call you (and everybody else who is late with the rent every month) to ask when they're going to get your rent? They shouldn't.
 
You're not being evicted, it's a standard "pay or quit" notice. It's got the same legal weight as a cottonball. It just means they think they haven't received their check.

Cancel the old check and issue a new one, and complain to the highest person in the food chain about the situation and the sh!tty managers.
 
I think you should look for a new place regardless...why u still want to live there with such horrible managment?
 
EXACT same thing happened to me! The bastards lost the check and then I had to pay the late fee. Couldnt argue, all I had was the copy of the check, and that could have been written any time. Now I make a point to specifically hand it to them.

This is real life advice. It takes at least 30 days to evict you.
Re-issue a check after checking with bank that the first hasn't gone through yet. Put a stop payment on it.
THEN , write a letter with delivery confirmation, and send it to the apt. manager relating the previous experience, your current one, and the lack of service from maintenance staff.
You cannot be evicted from any rental property if you've complained about service, in writing, and repairs are not done by the management, and you are forced to repair from your own funds. Rent can then be withheld by you in lieu of service, to the extent that the service cost.
 
Drop it in the mail every month, first class mail with signature confirmation. Costs $2 but you'll know exactly who loses the check.

This is some good advice. As stated it takes 30 days to even START the eviction proccess. if you fight it it will take months.

I would go in from now on and get a written reciept. That way you have proof that it was paid so there is not crap they can do about it.

I re-read the letter a few times while writing up the post, and realized that after 3 days they would begin "legal proceedings" against me.

The first thing I did when I got home was call the bank and see if any attempt had been made to cash it. Like if it had been stolen and someone tried to cash it but failed, which had not happened. So I had the teller put a stop on the check, that came to be a $29 fee which I'm planning on billing to the complex. 😉

The second was to double check that I had someplace to go if I absolutely had to.

Third thing was vent to my girlfriend, and the fourth was to post here. 😛

I'm already planning on taking an extended lunch tomorrow so I can drive back and have a chat with the manager about this. I'm a lot calmer about all of this now that I have a clearer understanding of what they can do, and this just re-affirms my decision to move when my lease is up in November.

I tried that once; the girl claimed they would not accept payments made directly unless it was late (great!), and that I had to put it in the drop box.
