First thing that came to mind was that it was a bit scammy for personal info. However, after looking up the case number on the LA county website, it's actually there. Ive bought at least two containers of ON whey so I'll participate for sure.

Whats the issue with ON because I use it a lot. So should I stop using it?

alleging that some of the advertising and product labels for the Covered Products contain misleading statements regarding the ingredient Aminogen® contained in the Covered Products.

found this on another site
The settlement will end the case, titles Attlesey et. Al. v. Optimum Nutrition Inc., which alleged that Optimum made false and/or misleading claims about the effectiveness of the enzyme Aminogen, which it used in its protein powder. While the company had advertised that Aminogen had the ability to improve one’s digestion and increase users’ level of amino acids, the complaint alleged that these claims were not based on reliable or competent scientific evidence.

TLDR: nothing wrong with ON, keep buying if you like it at the price point. get money if you bought and want to file a claim.

I'll have to check if I'm eligible, I think I bought a 5lb container last year.

$16.00 per unit of the Covered Products
Gold Standard 100% Whey, Gold Standard 100% Casein, Gold Standard 100% Egg, Platinum Hydrowhey, NitroCore 24, Whey Gold Meal, After Max, and Pro Complex (the “Covered Products”)
Is that the only "Covered Products" list they provide? Do they not care about quantity?

Because I think I bought some smaller packages of it as well, but those were under $16 at cost, I can't imagine they would give you more money back than you spent.

Do you know if they will require "proof of purchase" in the form of receipts?

Thanks.

Good thing I bought mine on Amazon. Bought probably at least seven tubs in the past year.

I hope bodybuilding.com has something similar in regards to invoice records.

Not that big of a deal and I will keep using it. I love ON and now I will basicly get a free tub which is great since I need more of the banana cream for my smoothies.

Yes, they do.

"Attach to the Claim Form documentation showing you purchased one of the above products during the required timeframe OR fully complete Question 2 on the Claim Form;"

Eh, don't think you do need to provide receipts actually.

Nice find OP. How did you find out about it?

After reading the FAQ I'm still wondering what exactly the lawsuit is about. What exactly is the plaintiff's complaint about Aminogen, if the plaintiffs didn't claim the products "were not efficacious or unsafe, or caused any physical injury", and how did they discover the problem that led to the lawsuit?

In any case all of the protein I buy is ON, so I'll be collecting $48 from this.

What other form of documentation would you provide? Even an online order form would be considered a type of receipt.

Hmmm...not sure if I want to support class action lawyers taking advantage of ON like that...

My thoughts as well. Does anyone know how this works? Is there a fixed amount that gets paid to lawyers and then they distribute some of it to whoever makes a claim and keep the rest as profit? Or does ON have to pay more for each claim submitted?

I'll probably fill one out either way, pays for a 5lb tub of it and they add up over a year.

Looks to me like it's saying please attach proof of purchase OR fully complete the second question on the claim form.

I'm thinking this too. The settlement agreement states that if there is excess money from the set amount to be awarded to claimants, then it will be donated to charity.

Since I don't really feel that ON has personally injured me, or misrepresented anything since I don't even recall reading that on the ingredients list and buying it for that reason. I'm just going to pass on this class action, and hopefully my part will go to charity.

Would be interesting for legal action to be based without proof of purchase... I just attached my email confirmation for an order I received.

I kinda agree with that premise, but I'm gonna fill out a claim since it's a fixed amount anyways and use it to buy my next 5lb of ON.

Thanks for this post. I believe the unregulated supplement industry is way out of control at this point with junk science claims and a correction is in order. Perhaps this represents an initial step in that direction. While I do not feel that this necessarily influenced my decision to purchase, my claim is submitted in the interests of providing some disincentive against this sort of reckless advertising.
