if you have a dog and it attacked and killed an innocent person, should you goto jail?

It depends on the circumstances. If the dog acted completely out of character, or it was tormented by someone or someone tried to attack the owner, then there should be no way anyone should go to jail. If however the dog was not trained and was being used by the owner in a negligent way, then yes, they should go to jail!

i dont know , people buy vicious dogs like pit bulls, rotwillers, etc , that's just asking for trouble.

I bet if you looked at the stats there is a higher % of attacks by mutts than these dogs.

If the owner is negligent in any way the owner should go to jail. For instance, if they didn't make an effort to keep the dog on a leash, or behind a fence. But maybe the neighbor let the dog out on accident or on purpose? Who knows. Case by case.

Only if the owner taught the dog to be that way or if the owner didn't have the dog locked up.

Well from what I've seem, Pitt Bull's and Rotties are not naturally mean dogs.
People with bad attitudes get them because they think they'll make BAD ASS dogs. Then they TRAIN them to be that way.
My dog is 1/4 Rottie and 1/4 Pitt Bull and 1/2 Chesapeake Bay Retriever and is gentle as a lamb. He caught a mouse one time, and didn't even hurt THAT. He goes to work with me every day and little kids crawl all over him. They pull his ears, tail, poke him in the eye's, no matter. He's still a big softie!
But then I knew when I got him he was going to be BIG and as a responsible pet owner I made SURE he was trained properly!
So in my opinion if someone's dog attacks someone, it's the OWNER'S fault, NOT the dog!
Dog's as a rule are only what YOU make them.

No dogs are born vicious. I have a doberman and he is the sweetest thing. He loves kittens and other small animals like guinea pigs. He likes to rub up against them and guard them from whatever trouble he thinks might be around. He also likes to eat cookies and he sings. His favorite song is "Baby Mine" from Dumbo. Whenever someone starts singing on TV he sings along with them. Vicious dogs are made that way by their owners.

i think dogs can be born with a tendency toward viciousness, and by training them you can bring it out further.

Yes I think so, the dog was your responsibility. I think this should also apply to gun laws, if you buy a gun you will go to jail if the gun was used to kill someone regardless who did it. Only exception is if it is stolen and then you would have to report it stolen.

Yeah, as eveyrone else has said, only if it's due to the owner's negligence. I had a neighbor once that threatened to sue us because her daugher came into OUR backyard, and started poking and kicking our dog in the rear-end (weird, I know). We saw this happening just in time to see our dog turn around and bite the girl on the arm. The girl of course started to bleed and cry. Her injury wasn't that bad at all, but of course the mother came around to chew us out.

That kind of stuff pisses me off beyond recognition. Keep your eyes on your damn kid, it's not my job. And if they come into my yard, and torment my dog, then maybe she'll learn a lesson from it. Notice the kid never came into our yard and messed with the dog again. ;)

BTW, the dog was a miniature snouzer, and no, the woman never sued.

it all depends,

if the dog was provoked probably not, also was the owner negligent or did the dog in some way escape

Most of the time when a dog attacks someone, it's because of the way they're treated at home. They're usually abused so when it gets loose he goes crazy. I think if the owner of the dog has treated the dog bad, and that is what caused him to freak out then yes, i think maybe a year behind bars would be fit for that kinda action.

now on the other hand if the guy who owned the dog never showed any possible signs of abuse towards the dog, and the dog itself just was a mental case from the start but never showed any signs until he killed someone, then i think that it would not be fit to put the owner in jail. maybe probation for a year? im not sure, thats just my opinion

on the issue of whether dogs are naturally violent, i take the same view as i do on humans.

there are those that are born such that they will always be violent, there are those born such that they will never be violent.
the vast majority are born in between, where how they are raised will determine (with varying degrees of impact) whether or not they are violent.

i do believe that some breeds have a greater tendency to naturally be more violent than others, but i still say that how they are raised ultimately determines their demeanor, for the vast majority of them.

well it all depends on the situation. A good example is something that happened to a friend of mine. She had when she was younger a rottweiler (I don't know if it was full or mixed). And a girl in her neighborhood apparently got bit by it. But the situation is kinda weird. The girl who got bit was 5 years old, she was by herself in the backyard of my friend when no one was home, and the dog was leashed up back there. They put the dog to sleep, but in a case like that I don't think even that shoulda happened. It was the little girl's parents' fault that she was alone in someone else's backyard playing with a rottweiler. Of course the girl didn't get killed or anything, but the dog was not responsible, or the owners.
