and tells you that you've been illegally downloading/uploading music, can you tell them that you didn't know you had an open WiFi? Is that a legitimate excuse?

Your ISP would probably prove otherwise.

However, I live in Canada and as far as I know, I haven't uploaded any music. ;)

If you let the RIAA look at your hard drive, you're an idiot. They'll drop suit the second they realize you aren't going to go quietly - and requiring them to get subpoenas and warrants isn't going quietly. And they sure as hell aren't going to pay for a forensic analysis if they DO get their hands on your gear, at worst they'll use off the shelf recovery software. A zeroed drive defeats that crap.

For P2P, it's a lot easier to defend yourself.

The RIAA's and MPAA's scanning methods only look for users with the file, they don't actually download it. You could rename a 3.5mb text file to OMGSREALLYPOPULARMUSIC.mp3 and they would think you are distributing copyrighted material.

Or wipe and reinstall. Big fvcking deal. They aren't going to pay for forensics. It would cost them more than they could ever recover from you, making the lawsuit unprofitable.
